<br /> 93 <br /> ORDINANCE 1983-23 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, ESTABLISHING A TEMPORARY <br /> 60-DAY MORATORIUM ON THE PROCESSING OF APPLICA-;; <br /> TIONS FOR SPECIFIC USE PERMITS AND CONDITIONAL; <br /> \ c <br /> USE PERMITS FOR ESTABLISHMENTS DESIRING TO DIS-~ <br /> PENSE ALCOHOLIC BEVERAGES WITHIN THAT AREA KNOW~ <br /> AS THE CENTRAL BUSINESS AREA OF SAID CITY BEYON . <br /> BEING ACCEPTED FOR FILING AND DECLARING AN .' <br /> EMERGENCY. <br /> WHEREAS, the City Council of the City of San Marcos, Texas, <br /> in order to better protect the health and safety of the public, <br /> is considering prohibiting or limiting the location of establish- <br /> ments which intend to dispense alcoholic beverages within that <br /> area of San Marcos known as the Central Business Area; and, <br /> WHEREAS, it will take approximately 60 days to properly <br /> consider the matter and to determine and adopt desirable regula- <br /> tions for property located in that zoning district known as <br /> the Central Business Area District; and, <br /> WHEREAS, it would be detrimental to allow the processing <br /> of specific use permits and conditional use permits for establish- <br /> ments desiring to dispense alcoholic beverages within that area <br /> known as the Central Business Area of said City to be initiated <br /> prior to the determination and adoption of said regulations; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. For the purposes of this Ordinance the portion <br /> of the City of San Marcos which is within the Central Business <br /> Area shall be as shown on Exhibit "A" attached hereto and made <br /> a part hereof. <br /> SECTION 2. No specific use permit or conditional use permit <br /> application for an establishment which desires to dispense alcoholic <br /> beverages within that area of the City of San Marcos known as <br /> the Central Business Area, shall be processed beyond being accepted <br /> for filing until July 8, 1983. <br /> SECTION 3. That the importance 0.£ this Ordinance creates an <br /> emergency and an imperative purpose necessary that the provisions <br /> of the charter requiring that ordinances shall be read at three <br /> separate meetings and that no ordinance shall become effective until <br /> tcheexpiratioh of ten (10) days following the date of its final <br /> passage be suspended,and these provisions are hereby suspended, and <br /> this Ordinance shall take effect and be in full force and effect <br /> from and after its adoption and publication in a newspaper of general <br /> circulation within the City. <br /> PASSED, MPRO~D ~D ADOPT~h day of May , 1983. <br /> , U <br /> Emmie Craddock <br /> Mayor <br /> J nis K.
