93 ORDINANCE 1983-23 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING A TEMPORARY 60-DAY MORATORIUM ON THE PROCESSING OF APPLICA-;; TIONS FOR SPECIFIC USE PERMITS AND CONDITIONAL; \ c USE PERMITS FOR ESTABLISHMENTS DESIRING TO DIS-~ PENSE ALCOHOLIC BEVERAGES WITHIN THAT AREA KNOW~ AS THE CENTRAL BUSINESS AREA OF SAID CITY BEYON . BEING ACCEPTED FOR FILING AND DECLARING AN .' EMERGENCY. WHEREAS, the City Council of the City of San Marcos, Texas, in order to better protect the health and safety of the public, is considering prohibiting or limiting the location of establish- ments which intend to dispense alcoholic beverages within that area of San Marcos known as the Central Business Area; and, WHEREAS, it will take approximately 60 days to properly consider the matter and to determine and adopt desirable regula- tions for property located in that zoning district known as the Central Business Area District; and, WHEREAS, it would be detrimental to allow the processing of specific use permits and conditional use permits for establish- ments desiring to dispense alcoholic beverages within that area known as the Central Business Area of said City to be initiated prior to the determination and adoption of said regulations; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. For the purposes of this Ordinance the portion of the City of San Marcos which is within the Central Business Area shall be as shown on Exhibit "A" attached hereto and made a part hereof. SECTION 2. No specific use permit or conditional use permit application for an establishment which desires to dispense alcoholic beverages within that area of the City of San Marcos known as the Central Business Area, shall be processed beyond being accepted for filing until July 8, 1983. SECTION 3. That the importance 0.£ this Ordinance creates an emergency and an imperative purpose necessary that the provisions of the charter requiring that ordinances shall be read at three separate meetings and that no ordinance shall become effective until tcheexpiratioh of ten (10) days following the date of its final passage be suspended,and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and publication in a newspaper of general circulation within the City.
