<br />95 <br /> <br />ORDINANCE NO. 1980-12 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND <br />CONDITIONS OF THE SALE BY THE CITY OF SAN <br />MARCOS, TEXAS, OF PART OF LOTS SEVEN (7) AND <br />EIGHT (8) IN BLOCK NO. TWO (2) OF THE J.S. <br />TRAVIS ADDITION TO THE CITY OF SAN MARCOS, <br />HAYS COUNTY TEXAS, TO MARVIN GILBREATH; <br />AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY <br />DEED TO MARVIN GILBREATH; AND DECLARING AN <br />EFFECTIVE DATE <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids <br />for the sale of that certain real property known as a part of <br />lots seven (7) and eight (8) in block no. two (2) of the J.S. <br />Travis Addition to the City of San Marcos, in Hays County, Texas, <br />also known as Urban Renewal Parcel No. 31A-9, in the San Marcos <br />Record, a local newspaper with a general circulation in the County <br />of Hays, State of Texas, on December 30, 1979 and January 2, 1980; <br />and, <br /> <br />WHEREAS, pursuant to said advertisement a bid was submitted <br />by Marvin Gilbreath for said described property in the amount of <br />six thousand one dollars ($6,001.00); and, <br /> <br />WHEREAS, said bid met the minimum disposition price set for <br />said property by the Urban Renewal Board of Commissioners of the <br />City of San Marcos, Texas; and, <br /> <br />WHEREAS, said Board accepted the bid as the highest and best <br />responsible bid for said property on January 8, 1980; and, <br /> <br />I <br /> <br />WHEREAS, said Board recommends the approval of said purchase <br />price and the approval of the terms and conditions for said sale, <br />as contained in the bid document; and, now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, <br />TEXAS: <br /> <br />SECTION 1. That the terms and conditions of the sale by the <br />City of San Marcos, Texas, of a part of lots seven (7) and eight <br />(8) in block no. two (2) of the J.S. Travis Addition to the City <br />of San Marcos, in Hays County, Texas, also known as Urban Renewal <br />Parcel No. 31A-9, the portion of said lots hereby conveyed front- <br />ing fifty five (55) feet on an alley in said block no. two (2) of <br />said Addition, and running back from said alley eighty (80) feet, <br />and being twenty eight and one-third (28 1/3) feet by eighty (80) <br />feet out of the northeast corner of said lot no. eight (8) and <br />twenty six and two thirds (26 2/3) feet by eighty (80) feet out of <br />the southeast corner of lot no. seven (7) in said block no. two (2), <br />the two portions of said lots lying together and constituting a <br />tract fifty five (55) feet by eighty (80) feet out of said two lots, <br />to Marvin Gilbreath, are hereby approved. <br /> <br />SECTION 2. That the consideration of six thousand one dollars <br />($6,001.00) for said property be, and is hereby, approved. <br /> <br />I <br /> <br />SECTION 3. That the purchaser is hereby placed on notice that <br />the subject property is subject to assessment under the provisions <br />of Article 1105b, Texas Revised Civil Statutes. <br /> <br />SECTION 4. <br />John A. Hansen <br />deed to Marvin <br />property. <br /> <br />That the mayor of the City of San Marcos, Texas, <br />be, and is hereby, authorized to execute a warranty <br />Gilbreath from the City of San Marcos, for said <br /> <br />SECTION 5. That this ordinance shall be in effect ten (10) <br />days from and after its passage and publication in a newspaper <br />of general circulation in the area. <br />
