<br />I <br /> <br />I <br /> <br />I <br /> <br />116 <br /> <br />ORDINANCE NO. 1980-14 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS GRANTING TO <br />RIVER TAXI SERVICE A FRANCHISE FOR ONE <br />YEAR TO OPERATE AND MAINTAIN A TAXI <br />SERVICE WITHIN THE CORPORATE LIMITS OF <br />SAID CITY FOR THE PURPOSE OF TRANSPORT- <br />ING PERSONS USING INNERTUBES ON THE SAN <br />MARCOS RIVER; PRESCRIBING THE TERMS, <br />CONDITIONS, OBLIGATIONS AND LIMITATIONS <br />UPON WHICH FRANCHISE SHALL BE EXERCISED <br />AND ESTABI,J;SHING AN EFFEX:TIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Def~nitions: As used in this Ordinance the <br />following words and phrases shall have the meaning ascribed to <br />them in this section: <br /> <br />A. City- The City of San Marcos, Texas, a municipal <br />corporation operating by and under the laws of the <br />State of Texas, situated in Hays County; <br /> <br />B. Service- River Taxi Service Incorporated, a Texas <br />corporation, or its legally determined successors <br />and assigns as approved by the San Marcos City <br />Council. .. <br /> <br />SECTION 2. Nature and Extent of Grant: For and in considera- <br />tion of Service equipping, maintaining and operating a taxi service <br />within the corporate limits of City for the purpose of transporting <br />persons using innertubes to float on the San Marcos River over the <br />route set forth on the map, identified as "Exhibit A", attached <br />hereto and by reference incorporated herein for all intents and <br />purposes, City grants to Service the right and authority to operate <br />and maintain a trailer for the transportation of persons and property <br />upon the public streets of the City described in Exhibit A for a <br />term of one (1) year from the effective date of this franchise. <br /> <br />SECTION 3. Route Changes: The route set forth on "Exhibit A" <br />may be amended by Service only after approval has been received from <br />the City Council of City. <br /> <br />SECTION 4. Equipment: The general design of the trailer used <br />by Service shall conform to the illustration identified as "Exhibit <br />B." The trailer shall be inspected and approved by the Director <br />of Public Safety of City prior to the effective date of this franchise. <br />'fhe trailer and any vehicle used to draw the trailer shall be well <br />maintained at all times and shall be operated only when in a safe, <br />dependable and sanitary condition. The trailer and any vehicle used <br />to draw it shall be operated in accordance with the laws of the <br />state of Texas and the charter and ordinances of City. Any vehicle <br />used to draw the trailer shall be driven only by a driver qualified <br />under the laws of the state of Texas. <br /> <br />SECTION 5. Rates of Fare: The services of Service shall be <br />offered and performed on the basis of rates of fare approved by <br />ordinance of the San Marcos City Council. <br /> <br />SECTION 6. Rate of Fare Adjustment: Service's rates of fare <br />may be changed by the express approval of the City Council of City <br />upon sixty (60) days prior notice to the Council of such proposed <br />rate schedule change and upon public hearing. The proposed rate <br />schedule shall also be published within thirty (30) days after such <br />filing of notice with the Council and prior to any public hearing on <br />the matter at least once in a newspaper of general circulation within <br />City. <br />
