<br />36 <br /> <br />ORDINANCE NO. 1980-3 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS, <br />ABANDONING A PORTION OF ROBERTS <br />STREET IN RIO VISTA TERRACE IN <br />THE CITY OF SAN MARCOS, TEXAS; <br />PROVIDING FOR THE REVERSION OF <br />THE FEE IN SAID LAND: AND DECLAR~ <br />ING AN EMERGENCY. <br /> <br />WHEREAS, Roberts Street in the City of San Marcos, Texas <br />was and is dedicated to public use as shown by the plat of the <br />Rio Vista subdivision in said City, as shown of record in Volume <br />132, Page 244, Hays County Deed Records; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />has determined that it is in the public interest to abandon a <br />portion of said Roberts Street, said portion being fUlly-described <br />in Exhibit A which is attached hereto and incorporated herein <br />for all intents and purposes; and, <br /> <br />WHEREAS, the owner of all land abutting said portion of <br />Roberts Street has executed a release, discharging said City <br />from any damages occasioned by said abandonment; and, <br /> <br />WHEREAS, pursuant to Article 5421c12 ~2(b), Texas Revised <br />Civil Statutes, the public easement in said portion of Roberts <br />Street is being sold to said abutting owner; and, <br /> <br />.1 <br /> <br />WHEREAS, pursuant to Article 5421c-12 ~4, Texas Revised <br />Civil Statutes, said sale is for the fair market value of said <br />interest being conveyed, said 'fair market value having been <br />determined by an appraisal obtained by said City; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That the portion of Roberts Street in the <br />Rio Vista Subdivision to the City of San Marcos, Texas, as <br />shown by Exhibit A be, and is hereb~ abandoned as a public <br />thoroughfare of any kind or character whatever. <br /> <br />SECTION 2. That the fee to the land in the portion of <br />Roberts Street described in Exhibit A is hereby released and <br />shall revert to Ileene Garrison save and except that easements <br />are reserved for any and all existing utilities. <br /> <br />SECTION 3. That the importance of this ordinance creates <br />an emergency and an imperative public purpose necessary that <br />the provisions of the City Charter requiring that ordinances <br />shall be read on three separate days and become effective ten <br />days thereafter be, and is hereby dispensed with, this ordinance <br />therefore to be in effect immediately upon its passage by this <br />body. <br /> <br />I <br /> <br />ADOPTED this 4th day February, 1980. <br />(\ .
