36 ORDINANCE NO. 1980-3 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ABANDONING A PORTION OF ROBERTS STREET IN RIO VISTA TERRACE IN THE CITY OF SAN MARCOS, TEXAS; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND: AND DECLAR~ ING AN EMERGENCY. WHEREAS, Roberts Street in the City of San Marcos, Texas was and is dedicated to public use as shown by the plat of the Rio Vista subdivision in said City, as shown of record in Volume 132, Page 244, Hays County Deed Records; and, WHEREAS, the City Council of the City of San Marcos, Texas, has determined that it is in the public interest to abandon a portion of said Roberts Street, said portion being fUlly-described in Exhibit A which is attached hereto and incorporated herein for all intents and purposes; and, WHEREAS, the owner of all land abutting said portion of Roberts Street has executed a release, discharging said City from any damages occasioned by said abandonment; and, WHEREAS, pursuant to Article 5421c12 ~2(b), Texas Revised Civil Statutes, the public easement in said portion of Roberts Street is being sold to said abutting owner; and, .1 WHEREAS, pursuant to Article 5421c-12 ~4, Texas Revised Civil Statutes, said sale is for the fair market value of said interest being conveyed, said 'fair market value having been determined by an appraisal obtained by said City; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the portion of Roberts Street in the Rio Vista Subdivision to the City of San Marcos, Texas, as shown by Exhibit A be, and is hereb~ abandoned as a public thoroughfare of any kind or character whatever. SECTION 2. That the fee to the land in the portion of Roberts Street described in Exhibit A is hereby released and shall revert to Ileene Garrison save and except that easements are reserved for any and all existing utilities. SECTION 3. That the importance of this ordinance creates an emergency and an imperative public purpose necessary that the provisions of the City Charter requiring that ordinances shall be read on three separate days and become effective ten days thereafter be, and is hereby dispensed with, this ordinance therefore to be in effect immediately upon its passage by this body.
