<br />54 <br /> <br />ORDINANCE No. 1980-8 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS <br />ABANDONING PORTIONS OF GUADALUPE <br />STREET, ROANOKE STREET, LYNDON B. <br />JOHNSON DRIVE, PLEASANT STREET, <br />PARK STREET, AND A PORTION OF AN <br />ALLEY EXTENDING NORTHWARD AND EAST- <br />WARD FROM PLEASANT STREET NEAR THE <br />INTERSECTION OF PLEASANT STREET AND <br />SESSOM DRIVE LOCATED WITHIN THE COR- <br />PORATE LIMITS OF SAID CITY; PROVID- <br />ING FOR THE REVERSION OF THE FEE IN <br />SAID LAND AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the hereinafter described portions of Guadalupe <br />Street, Roanoke Street, Lyndon B. Johnson Drive, Pleasant Street, <br />Park Street, and a portion of an alley extending northward and <br />eastward from Pleasant Street near the intersection of Pleasant <br />Street and Sessom Drive, said streets and alley located within <br />the corporate limits of the City of San Marcos, Texas, were and <br />are dedicated to public use as shown by the Quadrangle Maps pre- <br />pared for said City in 1975 and on file in the office of the City <br />Secretary of said City; and, <br /> <br />WHEREAS, the City of San Marcos has received from Southwest <br />Texas State University a petition requesting the abandonment by <br />said City of the hereinafter described portions of said streets; <br />and, <br /> <br />WHEREAS, the City of San Marcos has duly determined that <br />Southwest Texas State University is the sole owner of all property <br />abutting said portions of street and alley; and <br /> <br />I <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />has determined that it is in the public interest to abandon said <br />portions of said streets and alley; and, <br /> <br />WHEREAS, the owner of all land abutting said portions of <br />said streets and alley has executed a release, discharging said <br />City from any damages occasioned by said abandonment; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That the hereinafter described portions of <br />Guadalupe Street, Roanoke Street, Lyndon B. Johnson Drive, Pleasant <br />Street, Park Street, and a portion of an alley extending northward <br />and eastward from the north line of Pleasant Street, near the in- <br />tersection of Pleasant Street and Sessom Drive are hereby declared <br />to be and are henceforth abandoned as to any use, right or claim in, <br />or responsibility for the upkeep or maintenance by the public in <br />general and the City of San Marcos in particular: <br /> <br />(a) Guadalupe Street, from its intersection with the <br />south line of Matthews Street to its intersection with the north <br />line of Woods Streets. <br /> <br />I <br /> <br />(b) Roanoke Street, from its intersection with the east <br />line of Guadalupe Street to its intersection with the west boundary <br />of the University portion of Roanoke Street. <br /> <br />(c) Lyndon B. Johnson Drive, from its intersection with <br />the south line of Sessom Drive to its intersection with the north <br />line of Woods Street. <br /> <br />(d) Pleasant Street, from its intersection with the north <br />line of Sessom Drive to its intersection with the south line of <br />Peques Street. <br />
