ORDINANCE NO. 2015-02 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS ANNEXING INTO THE CITY THE REMAINING SECTION OF THE WONDER WORLD DRIVE EXTENSION, CONSISTING OF 27.4 ACRES OF LAND, MORE OR LESS, FROM THE BOUNDARY OF THAT SECTION OF WONDER WORLD DRIVE NEAR CRADDOCK AVENUE ANNEXED IN 2010 AND CONTINUING TO THE INTERSECTION WITH OLD RANCH ROAD 12; APPROVING A SERVICE PLAN FOR THIS AREA; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. On January 20, 2015, the City Council of the City of San Marcos, Texas provided an opportunity for all interested persons to be heard at a public hearing, to consider the proposed annexation by the City of the remaining section of Wonder World Drive, consisting of 27.4 acres of land, more or less, from the boundary of that section of Wonder World Drive annexed in 2010 and continuing to the intersection with Old Ranch Road 12 (the "Annexation Area "). The Annexation Area is further described by metes and bounds in Exhibit "A," attached hereto and incorporated herein for all purposes. 2. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 3. The requirements of Section 43.028 of the Texas Local Government Code and other applicable laws have been met. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The recitals of this ordinance are approved and adopted. SECTION 2. The Annexation Area is annexed to and is a part of the City of San Marcos, Texas and subject to the acts, ordinances, resolutions and regulations of the City. SECTION 3. The Service Plan for the Annexation Area, a copy of which is attached hereto as Exhibit `B" and incorporated herein for all purposes, is approved. SECTION 4. The corporate limits of the City are extended to include the Annexation Area. SECTION 5. The inhabitants, if any, of the Annexation Area are entitled to all the rights and privileges of other citizens of the City, and are bound by the acts, ordinances, resolutions and regulations of the City.
