ORDINANCE NO. 2015 -11 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 34 TITLED ENVIRONMENT <br />BY ADDING A NEW ARTICLE 7 THAT CREATES A RENTAL <br />NUISANCE ABATEMENT PROGRAM; PROVIDING A SAVINGS <br />CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING <br />PROVISIONS; INCLUDING PROCEDURAL PROVISIONS; PROVIDING <br />FOR PENALTIES; AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. In 2007, the City embarked on a process to evaluate and develop <br />standards for code enforcement of rental dwellings in the City. <br />2. In 2013, the Neighborhood Commission re- evaluated the concept <br />of rental registration to solve community wide issues related to <br />enforcement of codes. <br />3. The rental registration program being recommended by City staff <br />is intended to affect only those rental properties in conflict with <br />local codes and standards. <br />4. The City Council wishes to adopt this Rental Nuisance Abatement <br />Ordinance to reflect the City's unique needs. <br />5. The adoption of this Ordinance is in the interest of the public <br />health, safety and welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 34 of the City Code, titled Environment, is hereby amended by <br />adding a new Article 7, as shown in Exhibit A, attached hereto and made a part hereof for all <br />purposes. <br />SECTION 2. The newly added Article 7, including captions, numbering, fonts and <br />indentations, may be formatted consistent with the usual and customary formatting of the San <br />Marcos City Code by the Municipal Code Corporation. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this Ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this Ordinance will continue in force if they can be given effect without the invalid portion. <br />
