ORDINANCE NO. 2015 -16 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE SCHEDULE OF PERMIT FEES <br />PREVIOUSLY ADOPTED BY ORDINANCE NO. 2012 -38; INCREASING <br />THE SWIMMING POOL PERMIT FEE FROM $100 TO $200 FOR <br />PERMITS ISSUED DURING STAGES 2,3,4 AND 5 OF THE CITY'S <br />DROUGHT RESPONSE PLAN; INCLUDING PROCEDURAL <br />PROVISIONS AND ESTABLISHING AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br />Section 1. Ordinance No. 2012 -38, adopted on September 4, 2012, is hereby amended by <br />amending Exhibit A, Miscellaneous Fees, to increase the swimming pool permit fee from $100 <br />to $200 for permits issued during Stages 2,3,4,and 5 of the city's drought response plan. <br />Section 2: If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />Section 3: All ordinances and resolutions or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed. <br />Section 4: This Ordinance will become effective upon adoption on second reading. <br />PASSED on first reading on April 7, 2015. <br />PASSED ON SECOND READING, APPROVED, AND ADOPTED on April 21, 2015. <br />iel Guerrero <br />Mayor <br />Attest: Approved: <br />r ,l <br />Jamie ee Petti` hn Michae osentino <br />City Cl rk City Attorney <br />
