• ORDINANCE NO. 2009-82 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS <br />OF THE RUNOFF ELECTION HELD ON DECEMBER 15, 2009 FOR THE <br />PURPOSE OF ELECTING A CITY COUNCIL MEMBER, PLACE 5; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN <br />EMERGENCY. <br />RECITALS: <br />1. The City Council ordered that a Runoff Election be held on December 15, 2009 for the <br />purpose of electing a Council Member, Place 5. <br />2. Notice of this election was duly published in the San Marcos Daily Record on <br />November 25 and December 2, 2009. <br />3. A copy of the notice was posted on the bulletin board at City Hall on November 19, <br />2009. <br />4. This election was duly and legally held on December 15, 2009, in conformity with the <br />election laws of the State of Texas, and the results of the election have been certified and <br />returned by the proper judges and clerks. <br />5. The City Council of the City of San Marcos, Texas with the following members <br />present: Susan Narvaiz, Kim Porterfield, Pam Couch, Gaylord Bose, Fred A. Terry, <br />John Thomaides, and Chris Jones, has today considered the returns of the election held on <br />December 15, 2009. <br />6. It appears to the Council, and the Council finds, that the election was in all respects <br />lawfully held. <br />7. It appears to the Council, and Council finds, that the tabulation of the results of the <br />election, a copy of which is attached to this ordinance, is correct. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Runoff Election of December 15, 2009 was duly called, notice of the <br />election was given in accordance with law, and the election was held in accordance with law. <br />SECTION 2. The tabulation of votes cast in the Runoff Election held on December 15, <br />2009, a copy of which is attached to and made a part of this ordinance, is adopted as the official <br />tabulation of the votes cast at the election, and the tabulation will be filed and recorded in the <br />official records of the City of San Marcos as the official canvass of the election. <br />
