• ORDINANCE NO. 2009-65 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF THE GENERAL ELECTION HELD ON NOVEMBER 3, 2009 FOR THE PURPOSE OF ELECTING A CITY COUNCIL MEMBER, PLACE 5, AND A CITY COUNCIL MEMBER, PLACE 6; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. RECITALS: 1. The City Council ordered that a General Election be held on November 3, 2009 for the purpose of electing a Council Member, Place 5, and a Council Member, Place 6. 2. Notice of this election was duly published in the San Marcos Daily Record on October 6 and 13, 2009. 3. A copy of the notice was posted on the bulletin board at City Hall on September 2, 2009. 4. This election was duly and legally held on November 3, 2009, in conformity with the election laws of the State of Texas, and the results of the election have been certified and returned by the proper judges and clerks. 5. The City Council of the City of San Marcos, Texas with the following members present: Susan Narvaiz, Mayor, Gaylord Bose, Pam Couch, Chris Jones, Kim Porterfield, Fred Terry, and John Thomaides has today considered the returns of the election held on November 3, 2009. 6. It appears to the Council, and the Council finds, that the election was in all respects lawfully held. 7. It appears to the Council, and Council finds, that the tabulation of the results of the election, a copy of which is attached to this ordinance, is correct. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The General Election of November 3, 2009 was duly called, notice of the election was given in accordance with law, and the election was held in accordance with law. SECTION 2. The tabulation of votes cast in the General Election held on November 3, 2009, a copy of which is attached to and made a part of this ordinance, is adopted as the official • tabulation of the votes cast at the election, and the tabulation will be filed and recorded in the official records of the City of San Marcos as the official canvass of the election.
