ORDINANCE NO. 2009- 16 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM LOW DENSITY RESIDENTIAL <br />(LDR) TO MIXED USE (MU) FOR A 1.01 ACRE, MORE OR LESS, <br />TRACT OF LAND LOCATED AT 633 UHLAND ROAD; AMENDING <br />THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS <br />TRACT FROM SINGLE-FAMILY RESIDENTIAL DISTRICT (SF-6) <br />TO MIXED USE DISTRICT (MU); AND INCLUDING PROCEDURAL <br />PROVISIONS <br />RECITALS: <br />1. On February 10, 2009, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from Low Density Residential (LDR) to Mixed Use (MU), <br />and a concurrent request to change the zoning from Single-Family Residential District (SF-6) to <br />Mixed Use District (MU), for a 1,01 acre, more or less, tract of land located at 633 Uhland Road. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on February 10, 2009, and recommended that the <br />40 requests be approved by the City Council of the City. <br />3. The City Council held a public hearing g on March 31 2009, regarding, the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City, Master Plan is <br />revised to change the future land use designation for the following real property from Low <br />Density Residential (LDR) to Mixed Use (MU): <br />Street address: 633 Uhland Road <br />Size: 1.01 acres <br />• Legal description: 1.01 acres of land more or less out of the J.M.
