• ORDINANCE 2009- 24 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTIONS 82.232, <br />82.235, AND 82.239 OF THE SAN MARCOS CODE TO <br />REQUIRE THE SUBMISSION OF PARADE PERMIT <br />APPLICATIONS NOT LESS THAN FIFTEEN (15) DAYS <br />PRIOR TO THE PARADE; REQUIRING THE CHIEF OF <br />POLICE TO PROVIDE A WRITTEN EXPLANATION FOR <br />DENIAL OF A PARADE PERMIT; PROVIDING FOR APPEAL <br />OF THE DENIAL OF A PARADE PERMIT TO THE CITY <br />MANAGER; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Section 82.232 of the San Marcos City Code is amended to read as <br />follows: <br />Sec. 82.232 [Parade permit] Required. <br />• It is unlawful for any person to conduct or participate in any parade, other than a funeral <br />procession, upon any street without a permit issued by the chief of police. Application <br />for the permit shall be on a form provided by the police department, shall be made not <br />less than ten fifteen days before the time for the parade and shall be accompanied by a <br />fee established by the city council. The chief of police may waive the ten da? fifteen day <br />requirement for good cause. <br />SECTION 2. Section 82.235 of the San Marcos City Code is hereby amended to read as <br />follows: <br />Sec. 82.235. Issuance. <br />The chief of police shall issue a parade permit to the parade chairman, unless the chief of <br />police fiiw6 notifies the chairman in writing that: <br />(1) The date; times when the parade will assemble, start, or terminate; route; location of <br />assembly area; location of the disbanding area; or size of the parade will disrupt to an <br />unreasonable extent the movement of other traffic; <br />(2) The parade is of a size or nature that it requires the diversion of so great a number of <br />police officers to properly police the line of movement and the areas contiguous
