• ORDINANCE NO. 2009-23 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 14, BUILDINGS AND <br />BUILDING REGULATIONS, ARTICLE 6, PLUMBING CODE OF THE <br />SAN MARCOS CITY CODE TO CHANGE STANDARDS AND <br />REQUIREMENTS FOR IRRIGATION SYSTEMS; PROVIDING FOR <br />PENALTIES; AND, INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. The City Council of the City of San Marcos has determined that water conservation <br />and environmental protection are important issues and concerns affecting the city. <br />2. Properly-installed irrigation systems will conserve water, help avoid wasteful use, and <br />improve the overall quality of life for the citizens of San Marcos. <br />3. During the 2007 legislative session, the Texas Legislature adopted House Bill 1656 <br />that amended Chapter 401 of the Texas Local Government Code to require cities with a <br />population of 20,000 or more to regulate the installation of irrigation systems within the <br />corporate limits of the city as well as the city's extraterritorial jurisdiction. <br />4. The amendments in this ordinance are necessary to promote and protect the health, <br />safety, and welfare of the public by creating an urban environment that is protective of the city's <br />water supply and provides an enhanced quality of life for the citizens of the City of San Marcos. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS: <br />SECTION 1.
