ORDINANCE NO. 2016-11 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING VARIOUS SECTIONS OF THE LAND <br />DEVELOPMENT CODE AS FOLLOWS: AMENDING SECTION 2.1.1.1 <br />TO CLARIFY WHAT STANDARDS FROM CHAPTER 6 APPLY IN THE <br />EXTRATERRITORIAL JURISDICTION OF THE CITY; AMENDING <br />THE LAND USE MATRIX IN SECTION 4.3.1.2 TO MAKE HOSPITALS A <br />PERMITTED USE IN AREAS ZONED AS (P) PUBLIC AND <br />INSTITUTIONAL DISTRICTS AND TO ADD SENIOR HOUSING <br />COMMUNITY AS A NEW LAND USE UNDER THE RESIDENTIAL <br />USES SECTION OF THE MATRIX; AMENDING SECTION 6.2.1.2 TO <br />ADD MINIMUM OFF - STREET PARKING REQUIREMENTS FOR <br />SENIOR HOUSING COMMUNITIES; AND AMENDING CHAPTER S, <br />ARTICLE 2, TO ADD A NEW DEFINITION FOR SENIOR HOUSING <br />COMMUNITY; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR <br />THE REPEAL OF ANY CONFLICTING PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE. <br />1. City staff proposed and the Planning and Zoning Commission has considered and <br />recommended approval of revisions and amendments to the Land Development Code. <br />2. The City Council hereby finds and determines that the adoption of the following <br />ordinance incorporating such revisions and amendments is in the interest of the public health, <br />welfare and safety. <br />BE IT ORDAINED OF <br />SECTION 1. The Land Development Code is amended as set forth below. Added text <br />is indicated by underlining. Deleted text is indicated by strikethroughs. <br />SECTION 2. Section 2.1.1.1(a)(5) is amended as follows: <br />(a) Regulations and authority. The following regulatory standards <br />shall govern development in the City's extraterritorial jurisdiction and shall be <br />applied in deciding development applications in the extraterritorial jurisdiction: <br />(1) Standards governing annexation and development agreements in <br />this Chapter 2, Article 2, on the authority of and pursuant to Tex. <br />Loc. Gov't Code chs. 43 and 212, subchapter G; <br />(2) Policies and standards governing utility extensions in this Chapter <br />2, Article 3; <br />
