191 MINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUGUST 18, 1999 PRESENT: Mayor Mayor Pro-Tem Council Members City Manager Deputy City Manager City Secretary City Attorney Director of Public Works Billy G. Moore Ed Mihalkanin Jane Hughson Louis Doiron, Jr. Earl Moseley, Jr. Joe B. Cox, Jr. Rick Hernandez Larry Gilley Laura Huffman Janis K. Womack Mark Taylor George Boeker Also Present: Robert Habingreither, David Chiu, Collette Duran, Laurie Anderson, Gwen Smith, Ron Jager, Marie Jager, Bob Gratz, Bill Nance, Mike Abbott, John Boswell and others. Mayor Moore called the meeting to order at 7:00 a.m. Mayor Moore introduced an Executive Session pursuant to the Government Code, Section 551.071, to seek the City Attorney's advice regarding pending litigation, contemplated litigation, or other matters (Comanche Wells). Mr. Cox moved to adjourn into Executive Session at 7:04 a.m. and Mr. Moseley seconded the motion, which passed unanimously. Mr. Hernandez moved to reconvene at 8:24 a.m. and Mr. Mihalkanin seconded the motion, which passed unanimously (Mr. Doiron left the meeting at 7:45 a.m. and Mr. Moseley left the meeting at 8:10 a.m.). Mayor Moore stated there is a tentative contract. It will be provided to the Texas State University System this afternoon, and the Council will schedule an action item on the August 23, 1999 meeting for this matter. Mayor Moore introduced a discussion and direction to Staff regarding Comanche Wells. Staff was directed to move forward, to send the contract to SWTSU to review and get their response back as soon as possible. The meeting adjourned at 8:33 a.m. on motion made by Mr. Mihalkanin and seconded by Mr. Hernandez.
