ORDINANCE N0.2008 - 2 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS APPROVING THE SALE OF <br />LOT 15, THE RIDGE AT STONECLIFF, LOCATED AT <br />2242 SUMMIT RIDGE, TO DWAYNE THOMASON; <br />AUTHORIZING THE INTERIM CITY MANAGER TO <br />EXECUTE A DEED; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br />RECITALS: <br />1. The City is the owner of Lot 15, The Ridge at Stonecliff, located at 2242 Summit Ridge, <br />San Marcos, Texas. <br />2. A staff analysis has been made that has determined that there is no present or anticipated <br />future need for the City to retain fee ownership to this property. The City has recorded a utility and <br />access easement on the property to address present and future needs. <br />3 . The City has complied with the requirements of Section 272.001(b)(1) of the Texas Local <br />Government Code regarding the sale of surplus real property by sealed bidding, and the high bidder <br />for the purchase of this tract of property is Dwayne Thomason with a bid of $68,600.00. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. The sale of the parcel of real property described in Recital 1 above to Dwayne <br />Thomason is approved. <br />SECTION 2. Upon closing and receipt of total bid amount the Interim City Manager, <br />Collette Jamison, is authorized to execute the attached Special Warranty Deed conveying to Dwayne <br />Thomason the property described above. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. <br />PASSED AND APPROVED on first reading January 7, 2008. <br />
