Kyle, III, Frances Emory, Mario <br />Gutierrez, Roger Tatum, John McBride and others. <br />Mayor Moore called the meeting to order at 7:00 p.m. <br />Mayor Moore introduced for consideration adoption of an Annexation <br />Ordinance on emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 121.74 ACRES, MORE OR <br />LESS, LOCATED ADJACENT TO THE 5200 BLOCK OF INTERSTATE HIGHWAY 35 <br />SOUTH, EXTENDING SOUTHEAST TO AND ALONG FRANCIS HARRIS LANE TO THE <br />HAYS FNERGY LIMITED PARTNERSHIP POWER PLANT SITE; APPROVING A SERVICE <br />PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION AND DECLARING AN <br />EMERGENCY. <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Mr. <br />Hernandez seconded the motion. Joe Menard lives adjacent to this property <br />and asked the Council if the City would be strip annexing adjoining <br />property. He stated there are retirees on fixed incomes in the area that <br />do not wish to be annexed and cannot pay City taxes. Mayor Moore <br />indicated there is no plan to annex Mr. Bernard's property. Richard Keene <br />stated he is a resident of San Marcos and saw an article in the paper <br />regarding this business. It is his understanding it will use million of <br />gallons of water daily, will be a polluting power plant and the City is <br />providing them with a rebate. Mayor Moore advised Mr. Keene the water <br />will be recycled, and the tax abatement was given for a period of time to <br />keep the business in Hays County rather than the company locate in <br />Caldwell County. The business will provide jobs and bring in $350 million <br />to San Marcos, which is one-third of our current tax base. Mr. Cox added <br />it will be an immediate benefit to our School District in the area of $5 <br />million. Dianne Wassenich stated the nitrogen oxide impact of this plant <br />will equal the pollution of 30,000 cars. The Council voted unanimously <br />for adoption of the Ordinance on emergency. <br />Mayor Moore introduced Item 5, an Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice <br />regarding pending litigation, contemplated litigation, or other matters <br />(Comanche Wells Replacement Agreement with SWTSU).
