ORDINANCE NO.2018-03 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING THE CITY'S COMPREHENSIVE PLAN, <br /> VISION SAN MARCOS: A RIVER RUNS THROUGH US,BY AMENDING <br /> VARIOUS SECTIONS FOR CONSISTENCY WITH THE GOALS OF THE <br /> CITY'S NEW DEVELOPMENT CODE ("CODESMTX"), INCLUDING <br /> PROVIDING UPDATED DESCRIPTIONS OF AND VISIONS FOR <br /> IDENTIFIED DEVELOPMENT ZONES, ESTABLISHING EXISTING <br /> NEIGHBORHOOD AREAS OR LAND PRESERVATION AREAS AS TWO <br /> TYPES OF AREAS OF STABILITY, PROVIDING NEW DESCRIPTIONS <br /> FOR TYPES OF DEVELOPMENT CORRIDORS, AND AMENDING THE <br /> BOUNDARIES OF ACTIVITY NODES, EMPLOYMENT CENTERS AND <br /> INTENSITY ZONES DESCRIBED IN THE PREFERRED SCENARIO <br /> MAP; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE <br /> REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Following public hearings and community outreach, together with <br /> recommendations from various committees, boards and commissions, City staff proposed and the <br /> Planning and Zoning Commission has considered and recommended approval of revisions and <br /> r amendments to the City's Comprehensive Plan, Vision San Marcos: a River Runs Through Us. <br /> 2. The City Council, having considered all such recommendations, hereby finds and <br /> determines that the adoption of the following ordinance amending the City's Comprehensive Plan <br /> is in the interest of the public health, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The City's Comprehensive Plan,Vision San Marcos: a River Runs Through <br /> Us, together with the Preferred Scenario Map therein, is hereby amended as shown in Exhibit A, <br /> attached hereto and made a part hereof for all purposes. <br /> SECTION 2. All applications for Zoning Map Amendments duly filed and accepted under <br /> applicable ordinances before the effective date of this ordinance, and that have not expired or <br /> otherwise been denied, may continue to be considered and evaluated under applicable standards <br /> of the Comprehensive Plan and Preferred Scenario Map existing before the effective date of this <br /> ordinance. <br /> SECTION 3. If any word,phrase,clause,sentence,or paragraph of this ordinance is held <br /> to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in force if they can be given effect without the invalid portion. <br />
