ORDINANCE NO.2018-03 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE CITY'S COMPREHENSIVE PLAN, VISION SAN MARCOS: A RIVER RUNS THROUGH US,BY AMENDING VARIOUS SECTIONS FOR CONSISTENCY WITH THE GOALS OF THE CITY'S NEW DEVELOPMENT CODE ("CODESMTX"), INCLUDING PROVIDING UPDATED DESCRIPTIONS OF AND VISIONS FOR IDENTIFIED DEVELOPMENT ZONES, ESTABLISHING EXISTING NEIGHBORHOOD AREAS OR LAND PRESERVATION AREAS AS TWO TYPES OF AREAS OF STABILITY, PROVIDING NEW DESCRIPTIONS FOR TYPES OF DEVELOPMENT CORRIDORS, AND AMENDING THE BOUNDARIES OF ACTIVITY NODES, EMPLOYMENT CENTERS AND INTENSITY ZONES DESCRIBED IN THE PREFERRED SCENARIO MAP; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. Following public hearings and community outreach, together with recommendations from various committees, boards and commissions, City staff proposed and the Planning and Zoning Commission has considered and recommended approval of revisions and r amendments to the City's Comprehensive Plan, Vision San Marcos: a River Runs Through Us. 2. The City Council, having considered all such recommendations, hereby finds and determines that the adoption of the following ordinance amending the City's Comprehensive Plan is in the interest of the public health, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The City's Comprehensive Plan,Vision San Marcos: a River Runs Through Us, together with the Preferred Scenario Map therein, is hereby amended as shown in Exhibit A, attached hereto and made a part hereof for all purposes. SECTION 2. All applications for Zoning Map Amendments duly filed and accepted under applicable ordinances before the effective date of this ordinance, and that have not expired or otherwise been denied, may continue to be considered and evaluated under applicable standards of the Comprehensive Plan and Preferred Scenario Map existing before the effective date of this ordinance. SECTION 3. If any word,phrase,clause,sentence,or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion.
