102 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JULY 6,1999 PRESENT: Mayor Billy G. Wade, Chuck Davis, Paul Reed, Jerry Rademacker and others. Mayor Moore called the meeting to order at 5:30 p.m. Mayor Moore introduced for consideration approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF Sfu~ MARCOS, TEXAS, ESTABLISHING THE CITY OF SAN MARCOS DRAINAGE UTILITY BY AMENDING CHAPTER 86-UTILITIES OF THE SAN MARCOS CITY CODE TO ADD ARTICLE 8 - DRAINAGE UTILITY; DEDICATING CITY OWNED ASSETS TO THE UTILITY; ESTABLISHING A SERVICE AREA FOR THE UTILITY; AUTHORIZING THE PLANNING AND ENGINEERING DEPARTMENTS TO PROMULGATE RULES AND REGULATIONS FOR THE EFFICIENT ADMINISTRATION OF THE DRAINAGE UTILITY; ESTABLISHING THE DRAINAGE ADVISORY BOARD BY AMENDING CHAPTER 2, ARTICLE 3, DIVISION 7; AND PROVIDING AN EFFECTIVE DATE. Mr. Cox moved for approval of the Ordinance on second reading and Mr. Doiron seconded the motion. Mr. Gilley explained the four Options the Council could consider at this time and gave information regarding each one of the Options. Mr. Cox asked if staff would need to be added for Option 4 and Mr. Gilley stated no additional staff would be necessary. Mayor Moore stated the need to determine who would be exempt. Mr. Jenkins responded that the Council could determine exemptions either by the City Limits or have a distance to determine who would be outside and inside the perimeters to whether they would be exempt. Mr. Mihalkanin moved to amend phase in over three years and have a three tiered rate structure and Mr. Taylor stated a seperate Ordinance would be brought to the City Council and the Council could chose Option 3 & 4 at this time and extend to one year rather than make an amendment to this Ordinance. Mr. Doiron seconded the motion. The Council agreed to withdraw the amendment and give direction to Staff on this matter. Mr. Mihalkanin moved to amend by allowing owners of property to apply for credit up to 50% for residential and 25% for non-residential and Ms. Hughson seconded the motion. Mr. Doiron stated the rates of percent were too low and moved to amend Mr. Mihalkanin' s * Ms. Womack not present at this meeting. *Mr. Hernandez present at 5:40 p.m.
