38 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JUNE 1/ 1999 PRESENT: Mayor Billy G. Moore Mayor Pro-Tern Ed Mihalkanin Council Members Jane Hughson Louis Doiron, Jr. Earl Moseley, Jr. Joe B. Cox, Jr. Rick Hernandez City Manager Larry Gilley Deputy City Manager Laura Huffman City Secretary Janis K. Womack City Attorney * Mark Taylor Assistant City Attorney Mario Gutierrez Director of Planning and Dev. Ron Patterson Fire Chief Dan O'Leary Also Present: David DeKunder, Collette Duran, Melissa Millecam, Ron Hart, Dianne Wassenich, Tom Wassenich, John Hohn, Bryan Anderson, Dave Newman, Phillip Kelso and others. Mayor Moore called the meeting to order at 6:00 p.m. ~ayor Moore introduced for consideration adoption of a Resolution, the :aption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING INITIATION OF CONDEMNATION PROCEEDINGS AGAINST BMC WEST CORPORATION TO ACQUIRE A 0.5 ACRE, MORE OR LESS, TRACT OF LAND IN CONNECTION WITH THE CONSTRUCTION OF A PUBLIC ROAD ACROSS RANCH ROAD 12 FROM WYATT DRIVE; AND DECLARING AN EFFECTIVE DATE. Mr. Hernandez moved for adoption of the Resolution and Mr. Cox seconded the motion, which passed unanimously. Mayor Moore introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT BETWEEN THE CITY AND MIKE MOFFITT REGARDING THE CITY'S ACQUISITION OF A TRACT OF PROPERTY FROM BMC WEST CORPORATION FOR THE ENTRANCE ROAD TO THE MAJESTIC ESTATES SUBDIVISION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Cox moved for adoption of the Resolution and Mr. Doiron seconded the ~otion, which passed unanimously. Mayor Moore introduced for consideration an addendum, adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 58 - PUBLIC FACILITIES, PARKS AND RECREATION, OF THE CITY CODE BY ESTABLISHING A CURFEW AND PROHIBITING ACCESS TO THE SPRING LAKE DAM AREA; INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES AND DECLARING AN EMERGENCY. * Mr. Taylor not present at this meeting.
