109 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, FEBRUARY 7, 2000 PRESENT: Mayor Billy G. Moore Mayor Pro-Tem Council Members * * Ed Mihalkanin Jane Hughson Louis Doiron, Jr. Earl Moseley, Jr. Joe B. Cox, Jr. Rick Hernandez City Manager Deputy City Manager City Secretary City Attorney Larry Gilley Laura Huffman Janis K. Womack Mark Taylor Also Present: Collette Duran, Melissa Millecam, Sherri Russell. Mayor Moore called the meeting to order at 12:00 p.m. Mayor Moore introduced an Executive Session pursuant to the Government Code, Section 551.071, to seek the City Attorney's advice regarding pending litigation (City of San Benito vs. PG&E Gas Transmission lawsuit). Mr. Mihalkanin moved to adjourn into Executive Session at 12:01 p.m. and Ms. Hughson seconded the motion, which passed unanimously. Mr. Hernandez moved to reconvene from Executive Session at 12:12 p.m. and Mr. Doiron seconded the motion, which passed unanimously. ayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE REJECTING A SETTLEMENT AGREEMENT IN THE CITY OF SAN BENITO. VS. PG&E GAS TRANSMISSION LAWSUIT; REPEALING ORDINANCE 1999- 97 AND RESOLUTION 1999-228R RELATED TO SETTLEMENT OF THIS SUIT; AUTHORIZING THE CITY ATTORNEY TO DELIVER NOTICE OF THE CITY'S INTENT TO OPT OUT OF THE LAWSUIT; AND DECLARING AN EMERGENCY. Mr. Doiron moved for adoption of the Ordinance on emergency and Mr. Mihalkanin seconded the motion, which passed unanimously.
