ORDINANCE N0.2008 - 3 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 1, ARTICLE 9, DIVISION 5; <br />CHAPTER 6, ARTICLE 3; AND CHAPTER 8, ARTICLE 1 OF THE SAN <br />MARCOS LAND DEVELOPMENT CODE TO REVISE AND UPDATE THE <br />CITY'S SIGN REGULATIONS, TO ADD REGULATIONS FOR <br />CHANGEABLE ELECTRONIC VARIABLE MESSAGE SIGNS; PROVIDING <br />FOR PENALTIES; AND INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. I n accordance with Sections 1.2.4.1, 1.3.8.1, and 4.3.1.1 of the City Land <br />Development Code (the "LDC"), the Planning and Zoning Commission and the <br />City Council have considered proposed amendments to the following sections in <br />the LDC: <br />Chapter 1, Article 9, Division 5, concerning sign permits; <br />Chapter 6, Article 3, concerning development standards forsigns; and, <br />Chapter 8, Article 1 concerning definitions of Signs <br />2. The Planning and Zoning Commission held a public hearing on the proposed <br />amendments on January 22, 2008, and voted unanimously to recommend the adoption <br />of the proposed amendments to the City Council. <br />3. The City Council conducted a public hearing on the proposed amendments on <br />February 5, 2008. <br />4. All applicable requirements of the Land Development Code and of Chapters <br />211 and 212 of the Texas Local Government Code pertaining to subdivision and zoning <br />ordinance amendments have been met, and the City Council finds and determines that <br />the adoption of this ordinance is in the interest of the public health, morals, welfare and <br />safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. Chapter 1, Article 9, Division 5 of the San Marcos Land Development <br />Code is amended as follows (underlining indicates added text, ~ indicates deleted <br />text: <br />DIVISION 5: SIGN PERMIT <br />Section 1.9.5.1 Purpose, Applicability, Exceptions and Effect <br />(a) Purpose. The purpose of a sign permit is to authorize the display, erection, rebuilding, <br />restructuring, expansion, relocation, or structural alteration of any on-premise or off premise <br />sign. <br />
