ORDINANCE N0.2008 - 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 1, ARTICLE 9, DIVISION 5; CHAPTER 6, ARTICLE 3; AND CHAPTER 8, ARTICLE 1 OF THE SAN MARCOS LAND DEVELOPMENT CODE TO REVISE AND UPDATE THE CITY'S SIGN REGULATIONS, TO ADD REGULATIONS FOR CHANGEABLE ELECTRONIC VARIABLE MESSAGE SIGNS; PROVIDING FOR PENALTIES; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. I n accordance with Sections 1.2.4.1, 1.3.8.1, and 4.3.1.1 of the City Land Development Code (the "LDC"), the Planning and Zoning Commission and the City Council have considered proposed amendments to the following sections in the LDC: Chapter 1, Article 9, Division 5, concerning sign permits; Chapter 6, Article 3, concerning development standards forsigns; and, Chapter 8, Article 1 concerning definitions of Signs 2. The Planning and Zoning Commission held a public hearing on the proposed amendments on January 22, 2008, and voted unanimously to recommend the adoption of the proposed amendments to the City Council. 3. The City Council conducted a public hearing on the proposed amendments on February 5, 2008. 4. All applicable requirements of the Land Development Code and of Chapters 211 and 212 of the Texas Local Government Code pertaining to subdivision and zoning ordinance amendments have been met, and the City Council finds and determines that the adoption of this ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 1, Article 9, Division 5 of the San Marcos Land Development Code is amended as follows (underlining indicates added text, ~ indicates deleted text: DIVISION 5: SIGN PERMIT Section 1.9.5.1 Purpose, Applicability, Exceptions and Effect (a) Purpose. The purpose of a sign permit is to authorize the display, erection, rebuilding, restructuring, expansion, relocation, or structural alteration of any on-premise or off premise sign.
