ORDINANCE NO. 2021-24 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE CONVEYANCE AT NO COST <br />OF CITY -OWNED LOTS LOCATED AT 404 BROADWAY (ALSO <br />ADDRESSED AS 501-503 PARKDALE DRIVE), 300 HERNDON, 318 <br />SHADY LANE AND 207 SOUTH COMANCHE (ALSO ADDRESSED AS <br />213 SOUTH COMANCHE) TO QUALIFIED BUYERS UNDER <br />APPLICABLE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) <br />AND HOME GRANT PROGRAMS FOR THE PURPOSE OF <br />CONSTRUCTING AFFORDABLE SINGLE-FAMILY HOMES USING <br />GRANT FUNDS UNDER SUCH PROGRAMS; AUTHORIZING THE CITY <br />MANAGER, OR HIS DESIGNEE, TO EXECUTE CONTRACTS, DEEDS <br />AND ASSOCIATED CLOSING DOCUMENTS NECESSARY FOR THE <br />CONVEYANCE OF THESE LOTS UNDER TERMS AS ALLOWED <br />UNDER SAID GRANT PROGRAMS ON BEHALF OF THE CITY; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. City staff have identified five City -owned lots located at 404 Broadway (also addressed <br />as 501-503 Parkdale Drive), 300 Herndon, 318 Shady Lane and 207 South Comanche (also <br />addressed as 213 South Comanche) (individually, a "Lot" and collectively, the "Lots") as possible <br />locations for the construction of single-family homes using CDBG or HOME grant funding. The <br />Lots are shown in Exhibit A, attached hereto and made a part hereof. <br />2. The City Council hereby finds and determines that the conveyance at no cost of the Lots <br />to qualified owners under applicable CDBG and HOME program requirements promotes the goal <br />of providing affordable safe, decent and sanitary housing and is in the interest of the public health, <br />morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The conveyance of the Lots to qualified buyers for the construction of grant <br />funded single-family homes under applicable CDBG and HOME grant program requirements is <br />hereby approved. <br />SECTION 2. No contract providing for the conveyance of a Lot under Section 1 may be <br />entered into and no Lot may be sold unless it has first been determined by City staff, in <br />coordination with the City Attorney, that there are no defects in title, restrictions or conditions <br />affecting the suitability of the Lot for use as a single-family residence. <br />SECTION 3. Subject to Section 2, the City Manager, or his designee, is authorized to <br />execute contracts, deeds and closing documents for the conveyance of a Lot under terms as allowed <br />
