<br />the City of San Marcos from J. C. Hartley. Said deed being dated September 17, 1971, and recorded in Volume 179,
<br />pages 210-212, Hays County Deed Records.
<br />The Grantor for the consideration has granted, sold and conveyed, and by these presents does grant, sell and convey
<br />unto Grantee, the property, to have and to hold it together with all and singular the rights and appurtenances thereto
<br />in anywise belonging, unto the said Grantee. Grantee's heirs and assigns forever.
<br />As a part of the consideration of the property hereby conveyed, it is agreed and understood that the property shall he
<br />subject. always, to the restrictions imposed by the Governing body of said City of San Marcos in exercising
<br />Perpetual Care of the property. This provision is a covenant running with the land, binding upon the property, and
<br />the present and successive owners thereof, and inuring to the benefit of the Grantor, its successors and assigns, and
<br />to the benefit of the remaining crypts in such mausoleum, and the remaining lots in the cemetery, and the present
<br />and successive owners thereof.
<br />This deed is executed on behalf of Grantor by its Mayor, and attested by its City Clerk, as authorized by an
<br />ordinance passed on the 61" day of August, 924 o'f rd to in Vol. 6, at page 154, in the official minutes of Grantor's
