<br />and convey unto Grantee, the property, to have and to hold the above described premises, together with all and singular
<br />the rights and appurtenances thereto in anywise belonging, unto the Grantee, Grantee's heirs and assigns forever. As
<br />a part of the consideration of the property hereby oonvayed, it is agreed and understood that the property shall be
<br />aubject, m|wayo, to the restrictions imposed by the Governing body of said City of San Marcos in exercising Perpetual
<br />Care of the property. This provision is a covenant running with the |ond, binding upon the pmpohy, and the present
<br />and successive owners thereof, and inuring to the benefit of the Grantor, its successors and assigns, and to the benefit
<br />of the remaining lots in the cemetery, and the present and successive owners thereof.
<br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to the subsurface condition

<br />accept all risks os1msuch conditions and costs oaapart ofthis transaction.
