ORDINANCE NO. 2023-09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 14, BUILDINGS AND BUILDING REGULATIONS AND CHAPTER 38, FIRE PREVENTION AND PROTECTION OF THE CITY OF SAN MARCOS CODE OF ORDINANCES TO ADOPT THE 2021 INTERNATIONAL CODE COUNCIL (ICC) FAMILY OF CODES AND THE 2020 NATIONAL ELECTRIC CODE WITH AMENDMENTS; REPEALING CERTAIN PROVISIONS ADOPTING AND AMENDING PREVIOUS VERSIONS OF THE INTERNATIONAL CODES; AND PROVIDING FOR PENALTIES AND AN EFFECTIVE DATE. 1. The City currently uses versions of the International Codes such as the International Building Code, the International Residential Code, the International Energy Code and the International Fire Code as well as the National Electric Code, all from 2015 or earlier years with amendments previously adopted by the City to reflect the unique needs of the City as found in Chapters 14 and 38 of the City Code in order to regulate construction and fire safety in the City. 2. New versions of these Codes are periodically made available by the International Code Council, and the City Council finds it is necessary in the interests of the public health, safety, and welfare to update the International Codes utilized by the City. 3. The City now wishes to adopt the 2021 versions of its previously adopted International Codes, and to make changes to the codes to reflect the unique needs of the City as authorized by Chapter 214 of the Texas Local Government Code and other law. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 14, Buildings and Building Regulations, of the City Code is hereby amended to read as set forth in the document attached hereto and incorporated herein as Exhibit "A" (added language is underlined, deleted text is indicated by strikethrough). SECTION 2. Chapter 38, Fire Prevention and Protection, of the City Code is hereby amended to read as set forth in the document attached hereto and incorporated herein as Exhibit "B" SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion.
