ORDINANCE NO. 2023-09 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 14, BUILDINGS AND <br />BUILDING REGULATIONS AND CHAPTER 38, FIRE PREVENTION <br />AND PROTECTION OF THE CITY OF SAN MARCOS CODE OF <br />ORDINANCES TO ADOPT THE 2021 INTERNATIONAL CODE <br />COUNCIL (ICC) FAMILY OF CODES AND THE 2020 NATIONAL <br />ELECTRIC CODE WITH AMENDMENTS; REPEALING CERTAIN <br />PROVISIONS ADOPTING AND AMENDING PREVIOUS VERSIONS OF <br />THE INTERNATIONAL CODES; AND PROVIDING FOR PENALTIES <br />AND AN EFFECTIVE DATE. <br />1. The City currently uses versions of the International Codes such as the International Building <br />Code, the International Residential Code, the International Energy Code and the International <br />Fire Code as well as the National Electric Code, all from 2015 or earlier years with <br />amendments previously adopted by the City to reflect the unique needs of the City as found in <br />Chapters 14 and 38 of the City Code in order to regulate construction and fire safety in the <br />City. <br />2. New versions of these Codes are periodically made available by the International Code <br />Council, and the City Council finds it is necessary in the interests of the public health, safety, <br />and welfare to update the International Codes utilized by the City. <br />3. The City now wishes to adopt the 2021 versions of its previously adopted International Codes, <br />and to make changes to the codes to reflect the unique needs of the City as authorized by <br />Chapter 214 of the Texas Local Government Code and other law. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 14, Buildings and Building Regulations, of the City Code is hereby <br />amended to read as set forth in the document attached hereto and incorporated herein as Exhibit <br />"A" (added language is underlined, deleted text is indicated by strikethrough). <br />SECTION 2. Chapter 38, Fire Prevention and Protection, of the City Code is hereby <br />amended to read as set forth in the document attached hereto and incorporated herein as Exhibit <br />"B" <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />
