ORDINANCE NO. 2023-22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS REDUCING THE SPEED LIMIT ON SH 123 FROM 60 MILES PER HOUR TO 55 MILES PER HOUR; AUTHORIZING THE INSTALLATION OF SIGNS AND TRAFFIC CONTROL DEVICES REFLECTING THE NEW SPEED LIMITS; DIRECTING THAT THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE BE AMENDED TO REFLECT THE NEW SPEED LIMITS AND PENALTIES BE APPLIED ACCORDINGLY; AND INCLUDING PROCEDURAL PROVISIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Pursuant to Chapter 82 of the San Marcos City Code,and on the basis of an engineering and traffic study and a finding that a decreased speed limit is reasonable and prudent, following a request from TXDOT, the speed limits on SH 123 as depicted on the map attached hereto as Exhibit A are hereby decreased from 60 miles per hour to 55 miles per hour. More specifically the following speed limits are implemented: FOR SOUTHBOUND TRAFFIC Beginning under Control-Section 0366-01 starting from milepoint 11.632 (RM 12-Wonder World Dr-Redwood Rd)to milepoint 13.662 (Rattler Rd.), a distance of 2.030 miles, a prima facie maximum speed limit of 55 miles per hour. FOR NORTHBOUND TRAFFIC Beginning under Control-Section 0366-01 starting from milepoint 13.662 (Rattler Rd.)to milepoint 11.632 (RM 12-Wonder World Dr-Redwood Rd), a distance of 2.030 miles, a prima facie maximum speed limit of 55 miles per hour. SECTION 2. The City's traffic engineer is authorized to install such signs and traffic control devices as he deems appropriate to reflect the new speed limit. SECTION 3. The traffic engineer is directed to amend the traffic register maintained under section 82.067 of the San Marcos City Code to reflect the new speed limit and violations shall be subject to the penalties provided for accordingly. SECTION 4. If any word,phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed.
