ORDINANCE NO. 2023-22 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS REDUCING THE SPEED LIMIT ON SH 123 FROM 60 <br /> MILES PER HOUR TO 55 MILES PER HOUR; AUTHORIZING THE <br /> INSTALLATION OF SIGNS AND TRAFFIC CONTROL DEVICES <br /> REFLECTING THE NEW SPEED LIMITS; DIRECTING THAT THE <br /> TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br /> SAN MARCOS CITY CODE BE AMENDED TO REFLECT THE NEW <br /> SPEED LIMITS AND PENALTIES BE APPLIED ACCORDINGLY; AND <br /> INCLUDING PROCEDURAL PROVISIONS. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. Pursuant to Chapter 82 of the San Marcos City Code,and on the basis of an <br /> engineering and traffic study and a finding that a decreased speed limit is reasonable and prudent, <br /> following a request from TXDOT, the speed limits on SH 123 as depicted on the map attached <br /> hereto as Exhibit A are hereby decreased from 60 miles per hour to 55 miles per hour. More <br /> specifically the following speed limits are implemented: <br /> FOR SOUTHBOUND TRAFFIC <br /> Beginning under Control-Section 0366-01 starting from milepoint 11.632 (RM 12-Wonder <br /> World Dr-Redwood Rd)to milepoint 13.662 (Rattler Rd.), a distance of 2.030 miles, a prima <br /> facie maximum speed limit of 55 miles per hour. <br /> FOR NORTHBOUND TRAFFIC <br /> Beginning under Control-Section 0366-01 starting from milepoint 13.662 (Rattler Rd.)to <br /> milepoint 11.632 (RM 12-Wonder World Dr-Redwood Rd), a distance of 2.030 miles, a prima <br /> facie maximum speed limit of 55 miles per hour. <br /> SECTION 2. The City's traffic engineer is authorized to install such signs and traffic <br /> control devices as he deems appropriate to reflect the new speed limit. <br /> SECTION 3. The traffic engineer is directed to amend the traffic register maintained <br /> under section 82.067 of the San Marcos City Code to reflect the new speed limit and violations <br /> shall be subject to the penalties provided for accordingly. <br /> SECTION 4. If any word,phrase, clause, sentence, or paragraph of this ordinance is held <br /> to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br />
