ORDINANCE NO. 2023-21 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE ABANDONMENT OF 0.3269 <br /> ACRES (14,240 SQUARE FEET) OF PUBLIC RIGHT OF WAY KNOWN <br /> AS NASH LANE IN THE FINAL PLAT OF LOT 1, NASH SUBDIVISION, <br /> LOCATED IN THE VICINITY OF THE INTERSTATE 35 WEST <br /> FRONTAGE ROAD SOUTH OF YARRINGTON ROAD AND NORTH OF <br /> CHUCK NASH LOOP, SUBJECT TO REPLACEMENT RIGHT OF WAY <br /> BEING DEDICATED TO THE CITY; AUTHORIZING THE CITY <br /> MANAGER, OR HER DESIGNEE, TO EXECUTE THE QUITCLAIM <br /> DEED ON BEHALF OF THE CITY; INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The attached Quitclaim Deed is hereby approved, subject to replacement <br /> right of way approved by the Director of Planning and Development Services being dedicated to <br /> the City. <br /> SECTION 2. The City Council held a public hearing regarding the abandonment on <br /> February 21, 2023. <br /> SECTION 3. The City Manager, or her designee, is authorized to execute said Quitclaim <br /> Deed on behalf of the City. <br /> SECTION 4. If any word,phrase, clause, sentence, or paragraph of this ordinance is held <br /> to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 5: All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 6. This Ordinance will take effect immediately after the date of its final <br /> passage. <br /> PASSED AND APPROVED on first reading on February 21, 2023. <br /> PASSED,APPROVED AND ADOPTED on second reading on March 7, 2023. <br />
