ORDINANCE NO. 2023-21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE ABANDONMENT OF 0.3269 ACRES (14,240 SQUARE FEET) OF PUBLIC RIGHT OF WAY KNOWN AS NASH LANE IN THE FINAL PLAT OF LOT 1, NASH SUBDIVISION, LOCATED IN THE VICINITY OF THE INTERSTATE 35 WEST FRONTAGE ROAD SOUTH OF YARRINGTON ROAD AND NORTH OF CHUCK NASH LOOP, SUBJECT TO REPLACEMENT RIGHT OF WAY BEING DEDICATED TO THE CITY; AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO EXECUTE THE QUITCLAIM DEED ON BEHALF OF THE CITY; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The attached Quitclaim Deed is hereby approved, subject to replacement right of way approved by the Director of Planning and Development Services being dedicated to the City. SECTION 2. The City Council held a public hearing regarding the abandonment on February 21, 2023. SECTION 3. The City Manager, or her designee, is authorized to execute said Quitclaim Deed on behalf of the City. SECTION 4. If any word,phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5: All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. This Ordinance will take effect immediately after the date of its final passage. PASSED AND APPROVED on first reading on February 21, 2023. PASSED,APPROVED AND ADOPTED on second reading on March 7, 2023.
