Mayor Morris called the meeting to order at 9:33 p.m. ì1ayor 1"10 r r i s moved to Item 6 on the Agenda, an Executive Session pursuant to Article 6252-17, Section 2(e), V.A.C.S., to discuss pending litigation (GBRA vs. City of Lytle, Et AI) and contemplated litigation. Mr. Hernandez moved to adjourn into Executive Session at 9:35 p.m. and ¡VIr. Hart seconded the motion, ~vhich passed unanimously. Mr. Hernandez moved the Council reconvene at 11:30 p.m. and f"lr. Moore seconded the motion, \A,lhich passed unanimously. Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption whic h ~vas read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AI"IENDING THE CITY BUDGET ORDINANCE FOR THE 1989-1990 FISCAL YEAR (ORDINANCE 1989-38) TO PROVIDE FUNDING FOR PARTICIPATION IN AN ENDANGERED SPECIES ACT SUIT PERTAINING TO THE EDWARDS AQUIFER AND DECLARING AN EMERGENCY. Mr. ¡Vloore moved for adoption of the Ordinance on emergency and Mr. Hernandez seconded the motion, whic h passed unanimously. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ¡VIARCoS, TEXAS, AUTHORIZING THE PUBLIC WORKS DIRECTOR TO SUBMIT AN AMENDED APPLICATION FOR A¡VIENDI"1ENT OF THE CITY'S CERTIFICATE OF CONVENIENCE AND NECESSITY TO THE TEXAS WATER Col"I1"1 I SS ION; AND DECLARING AN EFFECTIVE DATE. Mayor Morris moved to table the Resolution and Mr. Moore seconded the motion, which passed unanimously. The meeting adjourned at 11:40 p.m. on motion made by 1"11"".
