ORDINANCE N0.2008-20 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE LAND USE <br />MAP FROM COMMERCIAL (C) TO HIGH DENSITY RESIDENTIAL <br />(HDR), FORA 5.073 ACRE, MORE OR LESS, TRACT OF LAND LOCATED <br />AT THE 2100-2200 BLOCK OF IH-3 5 NORTH; AND AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING A 5.309 ACRE <br />TRACT OF LAND, MORE OR LESS, LOCATED AT THE 2100-2200 <br />BLOCK OF IH-3 5 NORTH, FROM FUTURE DEVELOPMENT (FD) TO <br />MULTI FAMILY RESIDENTIAL DISTRICT (MF-18); INCLUDING <br />PROCEDURAL PROVISIONS. <br />RECITALS <br />1. On Apri122, 2008, the City Planning and Zoning Commission of the City of San <br />Marcos held public hearings regarding: a request to change the Land Use Map of the San <br />Marcos Horizons City Master Plan from Commercial (C) to High Density Residential (HDR) <br />fora 5.073 acre, more or less, tract of land located at the 2100-2200 Block of IH-35 North; and <br />a request to change the zoning of a 5.309 acre tract of land located at the 2100-2200 IH-35 <br />North from Future Development (FD) to Multi-Family Residential District (MF-18). <br />2. Subsequent to the public hearings on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests and recommended that the requests be approved by <br />the City Council. <br />3. The City Council held a public hearing on May 6, 2008 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation from Commercial (C) to High Density <br />Residential (HDR). <br />Street address: 2100-2200 Block of IH-35 North <br />Size: 5.073 acres <br />
