• RESOLUTION 2010-5R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AUTHORIZING THE PURCHASE OF TWO TAX FORECLOSED <br />LOTS FOR THE PURPOSE OF EXPANDING THE EDDIE DURHAM PARK; <br />AUTHORIZING THE CITY MANAGER TO MAKE AN OFFER OF <br />COMPENSATION TO HAYS COUNTY AND SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR THESE LOTS; <br />AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City has an opportunity to obtain two vacant lots that are contiguous to the <br />Durham Park Property. The lots would be used in the development of the Eddie Durham Jazz <br />Park. The Parks advisory board has recommended that the City obtain these lots at a minimal <br />cost. <br />2. The lots are being held by the taxing authority trustee, who has made some <br />preliminary inquiries with the School District and the County as to their willingness to accept a <br />nominal fee from the City for the purchase of the lots. The City's tax attorney believes that an <br />offer of about $2,500 would cover the costs of foreclosure and a slight return on the taxes owed. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />• <br />PART 1. The City Manager is hereby authorized to make an offer to purchase the <br />following tax foreclosed lots by payment of compensation to Hays County, Texas and the San <br />Marcos Consolidated Independent School District in an amount not to exceed $3,000: <br />A. A 37.5 foot by 65 foot tract out of Farm Lot No. 5. City of San Marcos, Texas; Tax <br />Account No. R27296; 205 MLK Drive; and <br />B. A Lot 5, and a portion of Lot 6, Block 5 also known as the East 48 feet of a portion of <br />Farm Lot 5; Tax Account No. R27294; 214 Centre Street. <br />PART 2.
