RECITAL S: <br /> <br />ORDINANCE 2004- 1 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING A 0.0899 ACRE, MORE OR LESS, TRACT <br />OF LAND LOCATED AT 310 MARY STREET FROM <br />"P" PUBLIC AND INSTITUTIONAL DISTRICT TO <br />"LB" LIMITED BUSINESS DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />1/,2. <br /> <br /> o <br /> <br /> 1. On September 23, 2003, the Planning and Zoning Commission of the City of <br />San Marcos held a public hearing regarding a request to change the zoning from "P" <br />Public and Institutional District to "LB" Limited Business District" for a 0.0899 acre, <br />more or less, tract of land located at 310 Mary Street. <br /> <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on September 23, 2003 consider and vote to approve the request, and <br />has recommended that the request be approved by the City Council of the City. <br /> <br /> 3. The City Council held a public hearing on the 12th day of <br />January ., 20014 regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code <br />pertaining to zoning map amendments have been met. <br /> <br /> 5. The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br /> SECTION 1. The Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real property <br />which is presently zoned "P" Public and Institutional District to "LB" Limited Business <br />District: <br /> <br />Street address: 310 Mary Street. <br /> <br />Legal description: A 0.0899 acre, more or less, part of Lot 5, Block 13, Lindsey <br />and Harvey Addition, a metes and bounds description of which is attached as <br />Exhibit A. <br /> <br /> <br />
