RECITAL S: ORDINANCE 2004- 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.0899 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 310 MARY STREET FROM "P" PUBLIC AND INSTITUTIONAL DISTRICT TO "LB" LIMITED BUSINESS DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 1/,2. o 1. On September 23, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "P" Public and Institutional District to "LB" Limited Business District" for a 0.0899 acre, more or less, tract of land located at 310 Mary Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on September 23, 2003 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 12th day of January ., 20014 regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "P" Public and Institutional District to "LB" Limited Business District: Street address: 310 Mary Street. Legal description: A 0.0899 acre, more or less, part of Lot 5, Block 13, Lindsey and Harvey Addition, a metes and bounds description of which is attached as Exhibit A.
