RECITALS: ORDINANCE 2004- 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 4.485 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED AT 2260 IH-35 SOUTH FROM 'T' INDUSTRIAL DISTRICT TO "C-2" HEAVY COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 1. On December 9, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from 'T' Industrial District to "C-2" Heavy Commercial District for a 4.485 acre, more or less, tract of property located at 2260 IH-35 South. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on December 9, 2003 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 12'ch day of January 2004,, regarding the request. 4. Ail requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safetyl BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "I" Industrial District to "C-2" Heavy Commercial District: Street address: 2260 IH-35 South.
