RECITALS: <br /> <br />ORDINANCE 2004- <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY ZONING A 10.8 ACRE, <br />MORE OR LESS, TRACT OF LAND LOCATED ALONG THE <br />NORTHWEST BOUNDARY OF THE BISHOP'S CROSSING, <br />SECTION' TWO SUBDIVISION AS "R-I" SINGLE-FAMILY <br />DWELLING DISTRICT (LOW DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />150. <br /> <br /> 1. On December 12, 2003, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to establish the zoning as "R-I" Single-Family <br />Dwelling District (Low Density) for a 10.8 acre, more or less, tract of land located Northwest of <br />the Bishop's Crossing, Section Two Subdivision. <br /> <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on December 12, 200 3'consider and vote to approve the request, and has recommended that <br />the request be approved by the City Council of the City. <br /> <br /> 3. The City Council held a public hearing on the 12th day of January <br />2 0 0 4 ,regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br /> 5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY~ OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to establish the zoning for the following real property as <br />"R-1" Single-Family Dwelling District (Low Density): <br /> <br />Street address:Along the boundary Northwest of Bishop's Crossing, Section Two <br />Subdivision. <br /> <br />Legal description: 10.8 acres in the B.J. White Survey, Abstract 469, a metes and <br />bounds description of which is attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 1056, Page 41, Hays County Official Public Records. <br /> <br /> <br />
