RECITALS: ORDINANCE 2004- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A 10.8 ACRE, MORE OR LESS, TRACT OF LAND LOCATED ALONG THE NORTHWEST BOUNDARY OF THE BISHOP'S CROSSING, SECTION' TWO SUBDIVISION AS "R-I" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 150. 1. On December 12, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to establish the zoning as "R-I" Single-Family Dwelling District (Low Density) for a 10.8 acre, more or less, tract of land located Northwest of the Bishop's Crossing, Section Two Subdivision. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on December 12, 200 3'consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 12th day of January 2 0 0 4 ,regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY~ OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to establish the zoning for the following real property as "R-1" Single-Family Dwelling District (Low Density): Street address:Along the boundary Northwest of Bishop's Crossing, Section Two Subdivision. Legal description: 10.8 acres in the B.J. White Survey, Abstract 469, a metes and bounds description of which is attached as Exhibit A. Deed or plat reference: Volume 1056, Page 41, Hays County Official Public Records.
