ORDINANCE NO. 2010-5 THE CITY COUNCIL OF THE CITY OF SAN AN ORDINANCE OF MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM 4'LDR" LOW DENSITY RESIDENTIAL TO "MU" MIXED USE FOR A 0.3028 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 716 SOUTH LBJ DRIVE; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "SF-6" SINGLE FAMILY RESIDENTIAL DISTRICT TO "MU" MIXED USE DISTRICT; AND INCLUDING PROCEDURAL PROVISIONS RECITALS: 1. On January 12, 2010, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the Future Land Use Map of the San Marcos Horizons City Master Plan from "LDR" Low Density Residential to "MU" Mixed Use, and a concurrent request to change the zoning from "SF-6" Single Family Residential District to "MU" Mixed Use District, for a 0.3028 acre, more or less, tract of land located 716 South LBJ Drive. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission considered and voted to approve the requests on January 12, 2010, and recommended that the requests be approved by the City Council of the City. 3. The City Council held a public hearing on February 2 2010 regarding the requests. 4. All requirements of Chapter 1, Development Procedures, of the City Land Development Code pertaining to Future Land Use Map Amendments and Zoning Map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is revised to change the future land use designation for the following real property from "LDR" Low Density Residential to "MU" Mixed Use: Street address: 716 South LBJ Drive Size: 0.3028 acres, more or less 9 Legal description: Lot 2, Block 8, Dan McKee 11
