217. <br /> <br />ORDINANCE 2004- $ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE RENAMING OF <br />THE SAN MARCOS FIRE DEPARTMENT TO SAN MARCOS <br />FIRE AND RESCUE; AMENDING THE CITY CODE; AND <br />INCLUDING PROCEDURAL PROVISIONS <br /> <br />o <br /> <br />RECITALS: <br /> <br /> 1. The Fire Department has requested that the name of the Department be changed to <br />"San Marcos Fire and Rescue" to better reflect the functions actually performed by the <br />department. <br /> <br />2. An amendment to City Code is needed to implement this change. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The San Marcos Fire Department is renamed "San Marcos Fire and <br />Rescue." <br /> <br />SECTION 2. Section 62.188 of the City Code is added to read as follows: <br /> <br />Sec. 62.188 Name of department <br /> <br /> The official name of the fire department is San Marcos Fire and Rescue. All <br />references in the City Code to "fire department" or "San Marcos Fire Department" mean <br />San Marcos Fire and Rescue. <br /> <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without theAnvalid portion. <br /> <br /> SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br /> SECTION 5. This Ordinance will take effect ten days after final passage, and the City <br />Clerk will publish notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading ganuary 12, 20 0 4. <br /> <br />PASSED AND APPROVED on second reading ,January 26, 2004. <br /> <br />PASSED, APPROVED AND ADOPTED February 9, 200/1. <br /> <br /> <br />
