52 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JUNE 14, 1976 Present: Emmie Craddock Mayor Councilmen Frank T. Arredondo Ted Breihan Robert L. Cavazos John Hansen Berry R. Lighthouse; Donald Tuff; Geneva Gomez; Polly Dusek; Maurice Erickson; Vernon Hartman; Jake Krauskopf; Terry Roberts; Melissa Millecam; Rowe Hay; Shirley Wickersham; Albert Sierra; and others. The Mayor called the meeting to order at 7:30 p.m. The Minutes of the Regular Meeting held May 24, 1976, were approved on motion of Mr. Hansen and second of Mr. Breihan. The Minutes of the Special Meeting held June 7, 1976, were approved on motion of Mr. Cavazos and second of Mr. Hansen, with Councilmen Breihan and Sutton abstaining. Mr. Cavazos moved to reappoint Dr. Glenn Longley and Mr. Gilbert Tenorio and appoint Dr. James Standley and Mr. Gerald Farr to the Environmental Advisory Connnittee. Mr. James seconded the motion, which passed unanimously. I Mayor Craddock read an Ordinance, the caption of which is as follows: AN ORDINANCE DETERMINING AND FilING THE MAXIMUM SCHEDULES OF RATES TO BE CHARGED BY ENTEX, INC., IN THE CITY OF SAN MARCOS, TEXAS, FOR NATURAL GAS AND NATURAL GAS SERVICE FURNISHED BY IT TO RESIDENTIAL AND COMMERCIAJ~ CONSUMEHS, CONTAINING DEFINITIONS, FilING THE EFFECTIVE DATES FOR GAS RATES PRESCRIBED IN THIS ORDINANCE, MA.KING MISCELLANEOUS PROVISIONS AND REPEALING ALL ORDINANCES IN CONFLICT. Mr. Hansen moved approval of the Ordinance on first reading. Mr. Arredondo seconded the motion. Mr. Sutton requested that the Exhibits be amended to change the date of September 1, 1973 to the effective date of the ordinance. Mr. Sutton warned the Council that if the September 1973 date were left in the Ordinance, that Entex would then try to recover lost gas cost adjustments. Mr. Breihan pointed out that September 1,~1973 was the effective date of the RailroadConnnission Order which allowed the pass through of increased gas cost, but did not allow the recovery of lost expenses. On roll call, the motion to approve the Ordinance on first reading passed with the following vote: AYE: Hansen, James, Arredondo, Brelhan, Cavazos, Craddock NAY: Sutton. The Mayor read the caption of an Ordinance as follows: I AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 19 OF THAT CERTAIN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, CODIFIED AS APPENDIX A IN THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY EXPANDING THE MEMBERSHIP OF THE BOARD OF ADJUSTMENT FROM FIVE TO SEV:I>N MEMBERS. Mayor Craddock explained that the Ordinance was in conflict with Article 1011g, V.T.C.S. (1971). Mr. Hansen moved the Ordinance not be approved. Mr. James seconded the motion, which passed unanimously.
