22 SPECIAL MEErING-OF THE CITY COUNCIL OF THE CITY OF~SAN' MARCOS, TEXAS, ~MAL~".:AYl9n. Present: Mayor Emmie Craddock Council Members Frank T. Arredondo Ted Breihan Robert L. Cavazos John Hansen Berry R. James Kenneth E. Sutton I City Attorney City Secretary Charles E. Evans Doriss Hambrick Also present: Albert Sierra; Terry Roberts; Pat Black; Allen King; and others. The Mayor called the meeting to order at ]:35 p.m. Mr. Hansen moved the Council recess to Executive Session to discuss pending litigation. Mr. Cavazos seconded the motion, which passed unanimously. The meeting was reconvened at 4:30 p.m. on motion of Mr. Hansen and second of Mr. Cavazos" The Mayor reported that the Council had discussed the litigation with J;egard to the election held April 30. She announced that a hearing had been scheduled for 11:00 a.m. Friday, May 6 to hear a motion filed by the City Attorney in response to the teD~orary restraining order issued by Judge Terry Jacks. Mr. James moved the Council reconvene on Friday, May 6 if the order were dissolved as a result of the hearing. Mr. Cavazos seconded the motion, which passed unanimously. I Mr. Arredondo moved to authorize the City Attorney to seek a writ of mandamus from a higher court if his motion to dissolve the restraining order were not approved so that the election could be canvassed. Mr. Cavazos seconded the motion, which passed unanimously. Mr. James moved to authorize the City Attorney to request that the bond filed in connection with the restraining order be increased to an amount to cover the cost of a new election and attendant fees.
