<br />22 <br /> <br />SPECIAL MEErING-OF THE CITY COUNCIL OF THE <br />CITY OF~SAN' MARCOS, TEXAS, ~MAL~".:AYl9n. <br /> <br />Present: <br /> <br />Mayor <br /> <br />Emmie Craddock <br /> <br />Council Members <br /> <br />Frank T. Arredondo <br />Ted Breihan <br />Robert L. Cavazos <br />John Hansen <br />Berry R. James <br />Kenneth E. Sutton <br /> <br />I <br /> <br />City Attorney <br />City Secretary <br /> <br />Charles E. Evans <br />Doriss Hambrick <br /> <br />Also present: Albert Sierra; Terry Roberts; Pat Black; Allen King; and others. <br /> <br />The Mayor called the meeting to order at ]:35 p.m. <br /> <br />Mr. Hansen moved the Council recess to Executive Session to discuss pending litigation. <br />Mr. Cavazos seconded the motion, which passed unanimously. <br /> <br />The meeting was reconvened at 4:30 p.m. on motion of Mr. Hansen and second of Mr. Cavazos" <br /> <br />The Mayor reported that the Council had discussed the litigation with J;egard to the <br />election held April 30. She announced that a hearing had been scheduled for 11:00 a.m. <br />Friday, May 6 to hear a motion filed by the City Attorney in response to the teD~orary <br />restraining order issued by Judge Terry Jacks. Mr. James moved the Council reconvene <br />on Friday, May 6 if the order were dissolved as a result of the hearing. Mr. Cavazos <br />seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />Mr. Arredondo moved to authorize the City Attorney to seek a writ of mandamus from a <br />higher court if his motion to dissolve the restraining order were not approved so that <br />the election could be canvassed. Mr. Cavazos seconded the motion, which passed <br />unanimously. <br /> <br />Mr. James moved to authorize the City Attorney to request that the bond filed in <br />connection with the restraining order be increased to an amount to cover the cost of <br />a new election and attendant fees.
