<br />REGULAR MEETr~G JUN~ 22, 1955 <br /> <br />133 <br /> <br />On this, the 22nd day of June, 1955, at 2:00 p.m., the City Council <br />of the City of San Marcos met in a regular meeting at the City Hall in <br />San Marcos, with the following members present and participating: <br /> <br />'~: <br /> <br />Frank E. Dietterich, Mayor <br />Calvin M. Allen, Alderman <br />Coy De Viney, Alderman <br />S. R. 3eecroft, Alderman <br />Frank D. Hill, Jr., Alderman <br />Harold G. Smith, Alderman <br /> <br />Others present were: <br /> <br />I <br /> <br />Horace C. Howard <br />Jim Walls <br /> <br />Paul J. Hoge rs <br /> <br />w. G. Barbee, Executive Seely <br />Ernest Morgan, City Attorney <br /> <br />A quorum being present, Mayor Dietterich ,called the meeting to order, <br />and the following transpired: <br /> <br />A resolution and an order cal1inQ: an election for the lssuance of <br />$350,000.00 to be used for highway ri~ht-of-way on Hwy. 81, was presented <br />to the Council for adoption. . Alderman Smi th made a motion that the <br />resolution and order be adopted. Alderman De Viney seconded the motion. <br />A vote was ta!{en which resulted unanlmously in favor of the motion. A <br />copy of the ~lection Crder and Resolution ~ollows these minutes and is <br />a part hereof. <br /> <br />Mr. 3aI'bee stated that the street Department is in need of the loader <br />whlch the Council approved at an earlier meeting. He stated that Dulaney <br />Service Company had agreed to sign a Lease Contract. The City would then <br />sign a note in the amount of ~6,000.00 with l~% interest, after making <br />a down pa~Qent of $1,370.60. Payments will bo $500.00 per month. <br />Mr. Barbee asked that the Council pass a resolution approving the note <br />and lease contract. On motion duly made, seconded and unardmously <br />carried, the foll'owing resolution was adopted: <br /> <br />RES 0 L UTI 0 N <br /> <br />I <br /> <br />BE I'r RL':SOLVED by the City Council of San Marcos, Texas, that the <br />following lease-purchase contract between Dulaney Service CompanYJ as <br />Lessor, and the City of San Marcos, as Lessee, be in all things approved <br />and said lease contract and the following note, shall be duly executed <br />by the Mayor, his signature to be attested by the Secretary, and the seal <br />of the City affixed thereto, and said contract shall thereafter consti- <br />tute a binding contract and obligation: <br /> <br />THE STATE OF TEXAS <br /> <br />COlTNTY OF' HAYS <br /> <br />CITY OF SAN IV'cARCOS <br /> <br />LEASE CONTRACT <br />----- <br /> <br />This Lease Contract is made and entered into on this the 22nd day <br />of June, 1955, by and between Dulaney Service Company, of San Antonio, <br />Texas, hereinafter called Lessor, and 'rhe City of San Marcos, Texas, <br />herein called Lessee: <br /> <br />ViITNl:;S3:2TH: <br /> <br />I <br /> <br />Lessee desires to obtain the use of the following described equip- <br />ment o~med by the Lessor, for t~e maintenance of the public roads, <br />streets and 0 ther publi c ways and faclli ti es wi thin the Ci ty of San J'Ilarco s, <br />Texas, said oquipment described as follows: <br /> <br />1 New ;Hnneapolis-'v!oline Model UTIL Industrial <br />Trac tor. Powered with gaso line Engine 57HP <br />Q 1300 RPI\!. 3hu ttle Heverse gear - 6 forward <br />and 6 reverse spe"ds. 12 Volt starting and <br />lighting equipment - 2 headlights and 1 red <br />tail light. Hydraulic Power steering. Two <br />(2) 8.25 x 20 10-ply front and two (2) 18.00 <br />x 26 lO-~ly rear tires. Complete with New <br />Seese Model C-IOO Hydraulic Controlled Front <br />End Loader and 1 cu yd bucket. Ballast Box <br />withounchinr;s.
