<br />SPECIAL MEETING ON FEBRUARY 28, 1956 <br /> <br />1 <br /> <br />On this, the 28th day of February, 1956, at 2:00 p.m., the City Council of <br />the City of San Marcos, Texas, met in a special meeting at the City Hall in <br />San Marcos, with the following members present and participating: <br /> <br />Frank E. Dietterich, Mayor <br />Calvin M. Allen, Alderman <br />Frank D. Hill, Jr., Alderman <br />Harold G. Smith, Alderman <br />S. R. Beecroft, Alderman <br />Coy De Viney, Alderman <br /> <br />I <br /> <br />Others pres ent: <br /> <br />W. G. Barbee <br /> <br />Ann Ziemke <br /> <br />Jim Walls <br /> <br />A quorum being present, the Mayor called the meeting to order, and the <br />following transpired 1 <br /> <br />An Order For City Officer's Election on April 3rd, 1956, was presented <br />to the Council for approval and adoption. A Notice of City Officers' Election <br />was also presented for approval. They were reviewed, after which Alderman <br />Smith made a motion that the Council approve the Order calling the City <br />Officers' Election on April 3, 1956, and give Mayor Dietterich authority to <br />sign same. Alderman Hill seconded the motion. A vote was taken which resulte d <br />unanimously in favor of the motion. Mayor Dietterich then signed the Order <br />which follows these minutes and is a part hereof. Alderman Smith made a motiom, <br />that the Notice of City Officerd' Election be approved. Alderman Hill seconded <br />the motion. A vote was taken which resulted unanimously in favor of the <br />motion. The Notice fo!ows these minutes and is a part hereof. <br /> <br />Mr. Barbee requested that he be given authority to invest the remaining <br />part of the Reserve Fund into Government Bonds. He stated that the balance <br />at present is $5,253.39. Alderman Allen made a motion that Mr. W. G. Barbee <br />be given authority to invest the remaining part of the Reserve Fund into <br />Government Bonds. Alderman Smith seconded the motion. A vote was taken which <br />resulted unanimously in favor of the motion. <br /> <br />I <br /> <br />Mr. W. G. Barbee then reported to the Council that .he City of San Marcos <br />,Building and Plumbing Ordinances provide for an Advisory & Appeal Board. <br />He stated that it has been requested that the Council appoint such 8 board <br />and a chairman for same. After a discussion, Alderman Smith made a motian <br />that Jack Major, J. P. Ellis, S. R. Beecroft and W. G. Barbee be appointed <br />to serve on the Advisory and Appeal Board and that S. R. Beecroft be <br />appointed as Chairman of said Board. Alderman Allen seconded the motion. <br />A vote was taken which resulted unanimously in favor of the motion. <br /> <br />A letter from Henry Kyle was then presented to the Council for review. <br />In the letter, Mr. Kyle stated that Refugio Padillo, the owner of the Northeast <br />half of Lot 8 of the A. F. Weatherford Subdivision, had consulted him with <br />reference to the damages that he has suffered when the City caused a sewer <br />line to be built across the Northwest end of his property near the M.K.& T. <br />Railroad right-of-way. Mr. Kyle stated that Mr. Padi110 claims he has <br />suffered damages to the extent of $750.00 and that he wishes to be paid. <br />The Council discussed this matter, after which Mr. Barbee was instructed to <br />refer this letter and the letters conserning Mr. A. F. Weatherford's claims <br />for damages to Kr. Ton Oliver, Attorney at Law, <br /> <br />I <br /> <br />A letter from Mr. Harold Legge, M.I.A., Austin, Texas, dated February 22, <br />1956, concerning the U.S. Highway 81 Right-of-way and his proposal on same <br />was presented to the Council. A letter from the City to Mr. Legge, accepting <br />his proposal, was also presented to the Council for approval. The letters <br />were read, after which Alderman Allen made a motion that the letter to <br />Mr. Harold Legge, accepting his proposal, be approved. Alderman Smith <br />seconded the motion. A vote was taken which resulted unanimously in favor <br />of the motion. the letters follow these minutes and are a part hereof. <br /> <br />There being no further business to discuss, the meeting was adjourned <br />at 2145 p.m. <br /> <br />The foregoing and <br />matters transpirin9 at <br /> <br />above minut, es is ,alrue aRd, correct record of all <br />the specift-l- meeting held _'\~ February 28, 1956. <br />1/ / <br />l .
