<br />I <br /> <br />I <br /> <br />I <br /> <br />SPECIAL MEETING APRIL 30, 1956 <br /> <br />81 <br /> <br />on this. the 30th day of April. 1956, the City council of the <br />City of San Marcos met in special session, pursuant to call of the <br />Mayor, at the City Hall in San Marcos, with the following members <br />present and participating: <br /> <br />Franl, E. Dietterich, Mayor <br />S. R. Beecroft. Alderman <br />C. M. Allen, Alderman <br />W. M. Davis, Alderman <br />B. D. Hillburn, Alderman <br />Herman Korff. Alderman <br /> <br />Also present were: <br /> <br />'I[. G. Barbee , Executive secretary Ernest Morgan, Ci ty Attorney <br />Tom G. Oliver, Attorney B. R. Gulledge <br /> <br />The Mayor announced the purpose of the me'eting was to discuss <br />ways and means of acquiring right-of-way property for the new <br />U. S. Hwy. 81. The council received reports of the committee <br />which had been assigned to work on the acquisition of these properties, <br />and discussed at length all phases of the problems relating to the <br />acquisition of said properties. Various ways and means of acquiring <br />the properties were discussed as well as cost estimate. employment, <br />of personnel, and other factors. The Council discussed the proposition <br />that the people of san Marcos had previously voted a $350,000.00 bond <br />issue for the purpose of acquiring this right-of-way, and the <br />council discussed the possibility that the actual acquisition cost <br />may exceed the sum. W. G. Barbee stated that additional sums of <br />money could be acquired through the issuance of warrants. Alderman <br />Beecroft and Allen both stated that in their judgment additional <br />warrants should not be issued in any amount exceeding $50,OJO.00. and <br />that if the acquisition cost exceed the existing voted bond issue, <br />together with an additional amount realized from a sale of warrants, <br />not exceeding 'ii;$O,O'JO.;)O. then the voters of San Marcos should be <br />given an opportunity to vote on the question of whether additional <br />funds would be used for the purchase of the right-or-way. <br /> <br />It was pointed out to the co~ncil that the appraiser heretofore <br />employed by the city to appraise the highway property would be in <br />position to report to the City within the next few days. <br /> <br />Alderman Beecroft moved that the bonds resulting from the <br />$350.000.00 bond issue be sold at the earliest possible time, and <br />money made available for the purchase of right-of-way property. This <br />motion was seconded by Alderman Allen and upon the question being <br />put, all Alderman voted unanimously in favor of the motion, whereupon <br />W. G. Barbee was, ordered to bring about the sale of said bonds as <br />early as possible. <br /> <br />Alderr.1an Beecroft made a motion that the highway right-of-way be <br />purchased at the earliest possible time. The motion was seconded by <br />Alderman Allen, and upon the question being put, all Aldermen voted <br />unanimously in favor of the motion. <br /> <br />Alderman Korff made a motion that J. Will campbell be employed <br />as a negotiator to purchase said highway properties for the city, <br />and that he commence his work at the earliest possible time, the <br />employment of campbell to be upon the terms and conditions as hereto- <br />fore outlined to the city council, and already appearing in the <br />minutes. Alderman Hillburn seconded the Dotion, and upon the <br />question being put, all Aldermen voted unani:ilously in favor of the <br />adoption of the motion. <br /> <br />Alderman Allen moved that all reports prepared by the appraiser <br />heretofore employed by the Ci t)r be turned over to the City Attorneys <br />Messrs, Tom G. Oliver, Jr., and Ernest Morgan. the information <br />contained in said reports to be by said attorneys used in connection <br />with representing the City in the purchase of rifpt~-way properties, <br />and the matters in said reports are to be by said attorneys treated <br />as confidential and not to be released to any unauthorized person. <br /> <br />The City'S attorneys, Messrs, Tom G. Oliver, Jr.. and Ernest <br />Morgan, were directed to release to the newspapers for publication <br />any information regarding the acquisition of said highway properties <br />that would not be prejudicial to the City in connection with negotia- <br /> <br />tions for the purchase of said properties. or any possible <br />
