M. Allen <br />presiding. <br /> <br />I <br /> <br />Present I Mayor C. M. Allen <br />Alderman: ~. R. Beecroft <br />W. M. Davis <br />B. D. Fuller <br />City Attorney Ernest Morgan <br />Deputy City Secretary Fritzie Turner <br /> <br />The meeting wa~ called to order by Mayor Allen who announced <br />the meeting .was called to di~cuss the matter of Right-of-way for RM 12. <br /> <br />The first matter considered by the Council was whether the <br />rock wall on Mrs. Read~s property was to be rebuilt by the City or if <br />she was to bear the expense. After considerable discussion,Alderman <br />Hillburn moved that the City offer Mrs. Read $1,500 and the City to <br />move the wall if nece~sary. This requirement on the City to expire at <br />the end of ten years or if Mrs. Read sold the property. A contract to <br />be given Mrs. Read covering this requirement. Alderman Tuttle seconded <br />the motion which carried unanimously. <br /> <br />I <br /> <br />The City Attorney asked the Council if the same consideration <br />given Mrs. Read's wall would hold true for the sidewalks and walls along <br />property owned by Mrs. Moore, Mrs. Carnes and Mrs. Fitzgerald. The Council <br />considered the matter and Alderman Hillburn made a motion to the effect <br />that sidewalks or walls torn up or damaged by the Highway Department in the <br />construction of the improvements are to be rebuilt by the City. Alderman <br />Tuttle seconded the motion. which carried unanimously. <br /> <br />The Council agreed to give Mrs. Carnes an additional $49.60 and <br />to enter into an agreement regarding reconstruction of any sidewalk or <br />wall damage in accordance with pOlicy just adopted. <br /> <br />Next, the Council considered possible damage to a tree on pro- <br />perty owned by Mr. Whitney. Alderman Beecroft made a motion that if the <br />tree is damaged by construction, is caused to lean or otherwise become <br />dangerous for a period of two years, ending January I, 1963, the City will <br />remove the tree at their expense and pay Mr. Whitney $200. The motion was <br />seconded by Alderman Tuttle and carried unanimously. <br /> <br />The Council was advised that Mrs. Frank Moore would, not settle <br />for the amount offered. After discussion, Alderman Tuttle moved that <br />Mrs. Moore be offered a total sum of $700. The motion was seconded by <br />Alderman Korff and carried unanimously. <br /> <br />I <br /> <br />The Construction agreement with the State Highway Department <br />for construction of the improvements on Ranch Road 12 was presented. The <br />Council considered the contract and authorized the Mayor to execute on <br />behalf of the City and the City Manager was directed to forward the <br />necessary funds to cover the City's portion of the cost .when requested <br />by the Highway Department. <br /> <br />The Council was informed that Radio ~tation KCNY had requested <br />permission to hold a Christmas Party in the City Recreation Building. <br />It was their plan to charge admission and to conduct a dance. The <br />ordinance requires that a dance permit be obtained and police officers, <br />in a number as required by the chief of Police, be in attendance. KCNY <br />representatives had objected to this procedure. The City Manager was <br />
