Fuller <br />Albert Walker <br /> <br />The Mayor called the meeting to order at 1:30 o'clock in the <br />afternoon. In the absence of the City Secretary, the City Manager <br />recorded the action of the Council. <br /> <br />The City Attorney explained the results of the depositions which <br />were taken in Cause No. 7954 in 155th District Court of Hays County <br />that morning, said Cause being titled Eddie Serur vs B.R. F~ller, <br />Individually, and the City of San Marcos. <br /> <br />I <br /> <br />The City Attorney stated that Counsel for the Plaintiff had indicated <br />that he would be amenable to a partial settlement with respect to the <br />sum requested from the City of San Marcos, and that the case against <br />B.B. Fuller had been dismissed with prejudice. The City Attorney <br />recommended that in the interest of economy, both time and financial, <br />the City make an offer of a sum approximately half the amount requested <br />by the Plaintiff, less any consideration for attorney's fees, which by <br />law he was excluded from receiving. <br /> <br />After consideration of the matter, Alderman Stokes moved that the City <br />Attorney be authorized to offer the sum of $250 as full, final and <br />complete settlement of this case and all other matters, past or future, <br />arising from the employment of the Plaintiff, Eddie Serur, up to <br />April 2, 1962, the date of his separation frem the City. Alderman Moore <br />seconded the motion. Vote of the Council members by roll call was <br />as follows: <br /> <br />Ayes: Moore, Ruiz, Stokes, Swift and Younger <br />Naysl None <br /> <br />Whereupon Mayor Allen instructed the City Attorney to exercise his <br />judgement in carrying out the wish of the Council. <br /> <br />The City Manager and the City Attorney excused themselves from the <br />meeting and Mrs. Dorothy Wor~ell was requested to come in and record <br />the following actionl <br /> <br />Alderman Swift moved that the City pay Mr. FUller's attorney fees to <br />Tom Oliver.
