<br />The Mayor called the meeting to order at 1130 p.m. Consent to Meeting was
<br />signed by Councilmen.

<br />First matter to come before the Council was consideration of File No. 8138
<br />in Hays County District Court. The Mayor called on City Attorney Albert M. Walker
<br />to state the nature of the case. Alderman Moore moved that the Citation be
<br />made a part of the official Minutes. Alderman Pool seconded the motion and on
<br />roll call, the following vote was recordedl

<br />The Mayor declared the motion carried and instructed the City Secretary
<br />to place File No. 8138 in the Minutes.
<br />
<br />The Mayor introduced a Resolution, attached here as a part of the Minutes.
<br />The Mayor read the Resolution, as follows:
<br />
<br />"WHEREAS, a suit has been filed against certain members of the
<br />City Council and City Officials; to wit: Councilmen Vim. L. Moore,
<br />William C. Pool, Ruben Ruiz and H. Garland Stokes, City Manager
<br />B.R. Fuller, City Attorney Walker and Chief of Police Dial; and,
<br />
<br />"WHEREAS, the style of the case is BILLY JAMES WHITE, Plaintiff,
<br />'versus THE, CITY OF SAN MARCOS et al Defendant, and is identified
<br />as File No. 8138 in the District Court of Hays County, Texas,
<br />155th Judicial District of Texas; and,
<br />

<br />"WHEREAS, it becomes necessary that the City of San Marcos do all
<br />things needful and proper to adequately defend the City and its
<br />Councilmen and Officials.
<br />
<br />"NOW, THEREFORE, BE IT RESOLVED by the City of San Marcos that
<br />proper legal counsel, suitable to the defendants, be employed
<br />to defend and protect the interest of the City, its Officers
<br />and Officials.
<br />
<br />"BE IT FUlITHER RESOLVED that all legal fees and other expenses
<br />inCurred in the defense of this or any suit connected herewith
<br />be paid from City funds."
