<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, APPROVING THE
<br />PRICE AND CONDITIONS OF THE SALE BY CITY
<br />OF SAN MARCOS, TEXAS, OF LOT 6 AND A
<br />PORTION OF LOTS 2, 3, 7 AND 8 AND AN
<br />ABANDONED ALLEY, ALL IN BLOCK 21 OF THE
<br />ORIGINAL TOWN OF SAN MARCOS (FURTHER
<br />DESCRIBED BY METES AND BOUNDS IN ATTACHED
<br />EXHIBIT A), ALSO KNOWN AS URBAN RENEWAL
<br />PARCEL NUMBER 1-1, LOCATED WITHIN THE
<br />TEX. A-6 NEIGHBORHOOD DEVELOPMENT PROGRAM
<br />AREA TO LEWIS GILCREASE, TRUSTEE FOR
<br />BALCONES SAVINGS ASSOCIATION; AUTHORIZING
<br />THE MAYOR TO EXECUTE A WARRANTY DEED TO
<br />LEWIS GILCREASE, TRUSTEE FOR BALCONES
<br />SAVINGS ASSOCIATION; AND DECLARING AN
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, the City of San Marcos, Texas, advertised for bids for
<br />the sale of that certain real property known as Lot 6 and a
<br />portion of Lots 2, 3, 7 and 8 and an abandoned alley, all in
<br />Block 21 of the Original Town of San Marcos (further described
<br />by metes and bounds in attached Exhibit A), also known as Urban
<br />Renewal Parcel No.1-I, located within the Tex. A-6, Neighborhood I
<br />Development Program area, published in the San Marcos Record, a
<br />local newspaper with a general circulation in the County of Hays,
<br />State of Texas; and,
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted by
<br />Lewis Gilcrease, Trustee for Balcones Savings Association for
<br />said Lot 6 and a portion of Lots 2, 3, 7 and 8 and an abandoned
<br />alley, all in Block 21 of the Original Town of San Marcos (furthe1
<br />described by metes and bounds in attached Exhibit A), also known
<br />as Urban Renewal Parcel No.1-I, located within the Tex. A-6,
<br />Neighborhood Development Program area; and,
<br />
<br />WHEREAS, the said bid met the minimum disposition price s,et upon
<br />said property by the Board of Commissioners of the Urban Renewal
<br />Agency of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the said Board accepted the bid as the highest and best
<br />responsible bid for said property by a motion duly passed on
<br />February 17,1978, after the bid opening of February 17,1978; an,
<br />
<br />WHEREAS, said motion also approved the terms and conditions for
<br />the sale of the said property and recommended the approval of sail
<br />purchase price and the approval of the terms and conditions for
<br />the sale, as contained in the bid documents, by the City Council
<br />of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in sail
<br />bid and the sales terms and conditions pertinent thereto conform
<br />to the Redevelopment Plan for the development of the City as a
<br />whole; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, of Lot 6 and a portion of Lots 2, 3,
<br />7 and 8 and an abandoned alley, all in Block 21 of the Original
<br />Town of San Marcos (further described by metes and bounds in
<br />attached Exhibit A), also known as Urban Renewal Parcel Number
<br />1-1, located within the Tex. A-6 Neighborhood Development Program
<br />Area, to Lewis Gilcrease, Trustee for Balcones Savings Associatic
<br />are hereby approved.
<br />
<br />SECTION 2. That the consideration for the sale for said property
<br />being $114,652.26 for 41,391 square feet is hereby approved.
