I I I ORDINANCE NO. 1979-4 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF PART OF LOTS 12, 13 AND 14, BLOCK 6 OF THE ORIGINAL TOWN OF SAN MARCOS, FURTHER DESCRIBED BY METES AND BOUNDS IN THE ATTACHED EXHIBIT A, LOCATED WITHIN THE TEX. A-6 NEIGHBORHOOD DEVELOPMENT PROGRAM AREA TO LEO P. CLOUD AND JERRY D. CLOUD; AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY DEED TO LEO P. CLOUD AND JERRY D. CLOUD; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, on the 26th day of January, 1976, adopted Ordinance 1976-7 approving the sale of Barts of Lots 12, 13 and 14, Block 6 of the Original Town of San Marcos, to Leo P. Cloud, Jr. and son; and, WHEREAS, subsequent to that sale the curb line for C. M. Allen Drive was constructed approximately 50 feet further from the property line of the above described Cloud property than proposed at the time of said sale leaving the property line 75 feet from the curb line of C. M. Allen Parkway; and, WHEREAS, Leo P. Cloud and Jerry D. Cloud now wish to purchase 50 feet of the above described 75 foot strip and have submitted a bid for purchase of same; and, WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales terms and conditions pertinent thereto conform to the redevelopment plan for the development of the City as a whole; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the terms and conditions of the sale by the City of San Marcos, Texas, of Parts of ~ots 12, 13 and 14, Block 6 of the Original Town of San Marcos, further described by metes and bounds in the attached Exhibit A, to Leo P. Cloud and Jerry D. Cloud are hereby approved. SECTION 2. That the consideration for the sale for said property being THREE THOUSAND SEVEN HUNDRED DOLLARS ($3,700.00) for 6,097 square feet is hereby approved. SECTION 3. That the sale by the City of San Marcos is made subject to restrictions of the redevelopment plan for the Tex. A-6 Neighborhood Development Program as approved and amended and on file and available for inspection in the office of the Director of Community Development of the City of San Marcos. SECTION 4. That the conditions of the disposition documents including the deed and contract for sale for private redevelopment are on file and are available for inspection in the office of the Director of Community Development of the City of San Marcos. SECTION 5: That the purchaser is hereby placed on notice that the subject property is subject to assessment under the provisions of Article 1105b of the Revised Civil Statutes of the State of Texas. SECTION 6. That the Mayor of the City of San Marcos, Texas, is hereby authorized to execute a warranty deed to Leo P. Cloud and Jerry D. Cloud from the City of San Marcos for all that real property known as Parts of Lots 12, 13 and 14, Block 6 of the Original Town of San Marcos, further described by metes and bounds in attached Exhibit A, located within the Tex. A-6 Neighborhood Development Program.
