<br />I <br /> <br />I <br /> <br />I <br /> <br />ORDINANCE NO. 1979-4 <br /> <br />4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING THE <br />PRICE AND CONDITIONS OF THE SALE BY THE <br />CITY OF SAN MARCOS, TEXAS, OF PART OF <br />LOTS 12, 13 AND 14, BLOCK 6 OF THE <br />ORIGINAL TOWN OF SAN MARCOS, FURTHER <br />DESCRIBED BY METES AND BOUNDS IN THE <br />ATTACHED EXHIBIT A, LOCATED WITHIN THE <br />TEX. A-6 NEIGHBORHOOD DEVELOPMENT PROGRAM <br />AREA TO LEO P. CLOUD AND JERRY D. CLOUD; <br />AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY <br />DEED TO LEO P. CLOUD AND JERRY D. CLOUD; <br />AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas, on the 26th day of <br />January, 1976, adopted Ordinance 1976-7 approving the sale <br />of Barts of Lots 12, 13 and 14, Block 6 of the Original Town <br />of San Marcos, to Leo P. Cloud, Jr. and son; and, <br /> <br />WHEREAS, subsequent to that sale the curb line for C. M. Allen <br />Drive was constructed approximately 50 feet further from the <br />property line of the above described Cloud property than <br />proposed at the time of said sale leaving the property line <br />75 feet from the curb line of C. M. Allen Parkway; and, <br /> <br />WHEREAS, Leo P. Cloud and Jerry D. Cloud now wish to purchase <br />50 feet of the above described 75 foot strip and have submitted <br />a bid for purchase of same; and, <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in <br />said bid and the sales terms and conditions pertinent thereto <br />conform to the redevelopment plan for the development of the <br />City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the terms and conditions of the sale by the <br />City of San Marcos, Texas, of Parts of ~ots 12, 13 and 14, <br />Block 6 of the Original Town of San Marcos, further described <br />by metes and bounds in the attached Exhibit A, to Leo P. Cloud <br />and Jerry D. Cloud are hereby approved. <br /> <br />SECTION 2. That the consideration for the sale for said property <br />being THREE THOUSAND SEVEN HUNDRED DOLLARS ($3,700.00) for 6,097 <br />square feet is hereby approved. <br /> <br />SECTION 3. That the sale by the City of San Marcos is made <br />subject to restrictions of the redevelopment plan for the Tex. A-6 <br />Neighborhood Development Program as approved and amended and on <br />file and available for inspection in the office of the Director of <br />Community Development of the City of San Marcos. <br /> <br />SECTION 4. That the conditions of the disposition documents <br />including the deed and contract for sale for private redevelopment <br />are on file and are available for inspection in the office of the <br />Director of Community Development of the City of San Marcos. <br /> <br />SECTION 5: That the purchaser is hereby placed on notice that the <br />subject property is subject to assessment under the provisions of <br />Article 1105b of the Revised Civil Statutes of the State of Texas. <br /> <br />SECTION 6. That the Mayor of the City of San Marcos, Texas, is <br />hereby authorized to execute a warranty deed to Leo P. Cloud and <br />Jerry D. Cloud from the City of San Marcos for all that real <br />property known as Parts of Lots 12, 13 and 14, Block 6 of the <br />Original Town of San Marcos, further described by metes and bounds <br />in attached Exhibit A, located within the Tex. A-6 Neighborhood <br />Development Program. <br />
