<br />6 <br /> <br />RESOLUTION NO, 1979.9.R <br /> <br />I <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING A <br />CONSTRUCTION AGREEMENT WITH MISSOURI <br />PACIFIC RAILROAD COMPANY FOR INSTALLATION <br />OF A WATER LINE UNDER RAILROAD TRACKS TO <br />CONNECT WITH A WATER LINE IN REDWOOD <br />ROAD; AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AGREEMENT; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas wishes to construct a <br />water line along Redwood Road in said City and, in order to <br />do so, needs to run a water line beneath the Missouri Pacific <br />Railroad tracks; and <br /> <br />WHEREAS, the Missouri Pacific Railroad Company required a <br />construction agreement be entered into, along with the payment <br />of a $500.00 Pipe Line License fee; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That the construction agreement in the form of a Pipe <br />Line Crossing License with the Missouri Pacific Railroad Company <br />for construction of a water line beneath the Missouri Pacific Railroad <br />tracks be, and is hereby, in all things approved. <br /> <br />I <br /> <br />Part 2. That the Mayor, Robert L. Cavazos, or his successor, be <br />and is hereby, authorized to execute said agreement on behalf of <br />the City. <br /> <br />Part 3. That the $500.00 Pipe Line License Fee has been approved <br />in the Community Development Program Year IV budget for construction <br />of a water storage facility. <br /> <br />Part 4.
