<br />I <br /> <br />I <br /> <br />I <br /> <br />14 <br /> <br />ORDINANCE NO.. 1979"5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE. <br />CITY OF SAN MARCOS, TEXAS, APPROVING THE <br />PRICE AND CONDITIONS OF THE SALE BY THE <br />CITY OF SAN MARCOS, TEXAS, OF LOT 0, <br />BLOCK 4 OF THE B. W. BREEDING ADDITION <br />TO THE CITY OF SAN MARCOS LOCATED WITHIN <br />THE TEX. A-6 NEIGHBORHOOD DEVELOPMENT <br />PROGRAM AREA TO ARTHUR CLAUDIS ARMSTEAD; <br />AUTHORIZING THE MAYOR TO EXECUTE A <br />WARRANTY DEED TO ARTHUR CLAUDIS ARMSTEAD; <br />AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids <br />for the sale of that certain real property known as Lot 0, <br />Block 4 of the B. W. Breeding Addition located within the <br />Tex. A-6 Neighborhood Development Program Area in 'the <br />San Marcos Record, a local newspaper with a general <br />circulation in the County of Hays, State of Texas; and, <br /> <br />WHEREAS, pursuant to said advertisement a bid was submitted <br />by Arthur Claudis Armstead for said Lot 0, Block 4 of the <br />B. W. Breeding Addition; and, <br /> <br />WHEREAS, the said bid met the minimum disposition price set <br />upon said property by the Board of Commissioners of the Urban <br />Renewal Agency of the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the said Board accepted the bid as the highest and <br />best responsible bid for said property by a motion duly passed <br />on February 6, 1979, after the bid opening of February 6, 1979; <br />and, <br /> <br />WHEREAS, said motion also approved the terms and conditions <br />for the sale of the said property and recommended the approval <br />of said purchase price and the approval of the terms and <br />conditions for the sale as contained in the bid documents by <br />the City Council of the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in <br />said bid and the sales terms and conditions pertinent thereto <br />conform to the Redevelopment Plan for the development of the <br />City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the terms and conditions of the sale by the <br />City of San Marcos, Texas, of Lot 0, Block 4 of the B. W. <br />Breeding Addition to Arthur Claudis Armstead are hereby <br />approved. <br /> <br />SECTION 2. That the consideration for the sale for said <br />property being Three Thousand Dollars ($3,000.00) for Fourteen <br />Thousand, Six Hundred Eight Square Feet (14,608 square feet) <br />is hereby approved. <br /> <br />SECTION 3. That the sale by the City of San Marcos is made <br />subject to restrictions of the Redevelopment Plan for the <br />Tex. A-6, Neighborhood Development Program, as approved and <br />amended, said plan is on file and is available for inspection <br />in the Office of the Director of Community Development of the <br />City of San Marcos. <br /> <br />SECTION 4. That the conditions of the disposition documents, <br />including the Deed and Contract for Sale for Private <br />Redevelopment, are on file and are available for inspection <br />in the Office of the Director of Community Development of <br />the City of San Marcos. <br />
