I I I 14 ORDINANCE NO.. 1979"5 AN ORDINANCE OF THE CITY COUNCIL OF THE. CITY OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF LOT 0, BLOCK 4 OF THE B. W. BREEDING ADDITION TO THE CITY OF SAN MARCOS LOCATED WITHIN THE TEX. A-6 NEIGHBORHOOD DEVELOPMENT PROGRAM AREA TO ARTHUR CLAUDIS ARMSTEAD; AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY DEED TO ARTHUR CLAUDIS ARMSTEAD; AND DECLARING AN EMERGENCY. WHEREAS, the City of San Marcos, Texas, advertised for bids for the sale of that certain real property known as Lot 0, Block 4 of the B. W. Breeding Addition located within the Tex. A-6 Neighborhood Development Program Area in 'the San Marcos Record, a local newspaper with a general circulation in the County of Hays, State of Texas; and, WHEREAS, pursuant to said advertisement a bid was submitted by Arthur Claudis Armstead for said Lot 0, Block 4 of the B. W. Breeding Addition; and, WHEREAS, the said bid met the minimum disposition price set upon said property by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas; and, WHEREAS, the said Board accepted the bid as the highest and best responsible bid for said property by a motion duly passed on February 6, 1979, after the bid opening of February 6, 1979; and, WHEREAS, said motion also approved the terms and conditions for the sale of the said property and recommended the approval of said purchase price and the approval of the terms and conditions for the sale as contained in the bid documents by the City Council of the City of San Marcos, Texas; and, WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales terms and conditions pertinent thereto conform to the Redevelopment Plan for the development of the City as a whole; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the terms and conditions of the sale by the City of San Marcos, Texas, of Lot 0, Block 4 of the B. W. Breeding Addition to Arthur Claudis Armstead are hereby approved. SECTION 2. That the consideration for the sale for said property being Three Thousand Dollars ($3,000.00) for Fourteen Thousand, Six Hundred Eight Square Feet (14,608 square feet) is hereby approved. SECTION 3. That the sale by the City of San Marcos is made subject to restrictions of the Redevelopment Plan for the Tex. A-6, Neighborhood Development Program, as approved and amended, said plan is on file and is available for inspection in the Office of the Director of Community Development of the City of San Marcos. SECTION 4. That the conditions of the disposition documents, including the Deed and Contract for Sale for Private Redevelopment, are on file and are available for inspection in the Office of the Director of Community Development of the City of San Marcos.
