I I I 32 ORDINANCE NO. 1979-6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS ANNEXING TO SAID CITY A CONTIGUOUS TRACT OF LAND CONTAINING .1377 ACRE LOCATED WITHIN THE EXTRA- TERRITORIAL JURISDICTION OF SAID CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos is the sole owner of a tract of land containing .1377 acre, which land is contiguous and adjacent to present City boundaries and located within said City's extraterritorial jurisdiction; and, WHEREAS, Paragraph (a), Subsection B-1, Section 7 of the Municipal Annexation Act (Article 970a TEX. REV. CIV. STAT. ANN.) allows a home rule City to annex area of a width at its narrowest point of less than 500 feet initiated upon written petition of the owner of said area; and, WHEREAS, said written petition is not necessary in this case because the City of San Marcos is the sole owner of the area in question; and, WHEREAS, a description of said tract by metes and bounds is attached hereto and incorporated herein for all intents and purposes as "Exhibit A"; and, WHEREAS, an opportunity has been provided after proper notice for all interested persons to be heard on the matter of said annexation at a public hearing held on February 5, 1979, said date being not less than ten (10) days nor more than twenty (20) days prior to the first reading of this ordinance; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the .1377 acre tract, part of and ~ut of: the J. ~1. Veramendi League No.1, as recorded in Volume 133, Page 594 of the Hays County Deed Records, and owned by the City of San Marcos, said tract being more fully described by metes and bounds description in "Exhibit A" attached hereto and incorporated herein, be, and is hereby, annexed into the incorporated area of the City of San Marcos. PART 2. That the corporate limits of said City be, and are hereby, extended to include said newly annexed .1377 acre. PART 3. That said .1377 acre shall henceforth be a part of the City of San Marcos, and any inhabitants thereof shall be entitled to all the rights and privileges of all citizens, and shall be bound by the acts and ordinances, resolutions and regulations of the City. PART 4. That this Ordinance shall be in full force and effect ten (10) days from and after final passage and publication in a newspaper of general circulation.
