I I I 33 ORDINANCE NO. 1979- 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS ANNEXING TO SAID CITY A CONTIGUOUS TRACT OF LAND CONTAINING IS.30 ACRES LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF SAID CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, Pamela G. Dimmick and George E. Dimmick, the sole owners of a tract of land containing IS.30 acres, which land is contiguous and adjacent to present City boundaries and located within said City's extraterritorial jurisdiction, have duly petitioned by written petition, the City of San Marcos to annex said tract to be hereafter incorporated for all purposes within the boundaries of said City; and WHEREAS, said petition has been heard and considered by the City Council; and WHEREAS, a copy of said petition is attached hereto and incorporated herein for all intents and purposes as "Exhibit A"; and WHEREAS, a description of said tract by metes and bounds is attached hereto and incorporated herein for all intents and purposes as "Exhibit B"; and WHEREAS, an opportunity has been provided after proper notice for all interested persons to be heard on the matter of said petition at a public hearing held on February 5, 1979, said date being not less than ten (10) days nor more than twenty (20) days prior to the first reading of this Ordinance; and WHEREAS, said petitio,n for annexation should be and is hereby granted; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Part 1. That the IS.30 acres tract, part of and out of the T. J. Chambers Survey, as recorded in Volume 165, Page 167 of the Hays County Deed Records, and owned by Pamela G. Dimmick and George E. Dimmick, said tract being more fully described by metes and bounds description in "Exhibit B" attached hereto and incorporated herein, be and is hereby annexed into the incorporated area of the City of San Marcos. That the corporate limits of said City be and are hereby extended to include said newly annexed IS.30 acre tract. Part 2. Part 3. That said IS.30 acre tract shall henceforth be a part of the City of San Marcos, and any inhabitants thereof shall be entitled to all the rights and privileges of all citizens, and shall be bound by the acts and ordinances, resolutions and regulations of the City. Part 4. That this Ordinance shall be in full force and effect ten (10) days from and after final passage and publication in a newspaper of general circulation.
